i got some questions.

Now i wanna make sure what i am doing is right. it says on the top of N-400 form. so should i write all the form with Capital letter?

Print clearly or type your answers using CAPITAL letters. Failure to print clearly may delay your application. Use black ink.

G. How many times has your current spouse been married (including annulled marriages)? is this mean the past including the present? or just the past one?

Yes just write in Caps... If you are able to - I'd recommend that you compelete the form on the Computer then print it off. They probably recommed CAPS because it's easier to make out as some people have a real bad penmanship..!!

Part 8, G. is asking for the past one.

We didn't follow the cap rule and got away with it, so much easier to read especially if you have a surname with lower case letters in it. And those long Spanish address names. I used Adobe Acrobat Pro with font size changing capability. to fit those long names in those tiny blanks. But not recommending it. Marriages are total number of marriages, including your present one.

1. I type mine all CAPS on the computer and print it out.

2. If your spouse has been married in the past before you then you have to put how many times he/she got married in the past including you.

I have a friend who removed successfully his 2 years conditions about 5 months ago, but her wife and him are having relationship problems and are about to divorce. He is scared to have problems (because the new 10 years card is recently produced) and he is concern about that his wife could call immigration and put him on trouble.

He wants to wait 5 years to apply for citizenship and not 3 years because the relationship is not so good.

Could he really get any problems at this time or for citizenship (naturalization process)?

he has to wait anyway since he is going through divorce. he cannot submit the N400 by the 3 year rule since he won't be married. he needs to wait until the 5 year since the date he became a LPR. 90 days prior to the 5th year anniversary, he can file the N400.

No relationship is perfect..some works and some don't no matter how hard you try eventhough both people feel that they are perfect for each other at first. It's up to them if they want to make things work. Eventhough they are having problems along the way the main concern that the immigration is looking at is wether your friend came here in the US and married your friend not just for GC. As long as their relationship or marriage was genuine before he enters the US then I dont see why your friend would be in trouble. Did he asked his wife to marry him just for greencard or anything like that? If NOT, then he has nothing to worry about.

Thanks to all for your replies.... I have understand the wait for 5 years (and not 3) as he potentially wont be married by this time with the same US Citizen who bring him to this country.

This marriage is a genuine relationship, happy moments, discussions, and everything is like a "normal" couple has to face...

Before he came to US and during those 2 years of conditional card they had a lot of proof or real relationship, trips, vacations, a lot of photos, taxes, bank accounts, hospitals bills, insurance, apartment lease etc etc.

They were approved for the 10 years GC without interview about 5 month ago, I remember helped them to prepare the i751 with a lot of evidence, but he is having a lot of problems with her and she have asked him divorce.

Keeping the personal relationship facts apart, and focusing on the immigrations status, would be safe for him start the divorce this time ?

If they wanted to have the divorce I dont see a problem that would affect his GC. He has a 10yr GC which means he should be fine as long as he waits after 5yrs to file for citizenship. Goodluck and your friend is lucky to have a good friend like you. Sorry to hear about your friends marriage not working out but it is what it is and there is no permanent thing in this world and unluckily things just doesn't work out for them. Life is short live it and enjoy while you still can!

Thanks for your words Lhiz21, this is exactly my point... He asked me the best way to finish the relationship, he love her, but things just are getting worse and are not working out.... I just tell him that I can't help on that, but at least, under all stress that is should be this situation to have also an immigration status worry is even worse.
