Good day all...This is my short story I got married in philippines , can i file divorce even if our marriage held in the philippines, will it be granted here in USA?.

I was married in Costa RIca. I went back to Costa Rica to file for my divorce. The CR embassy here in the US told me I needed to file there because it would not be recognized there if I filed here. I am still waiting for the papers to be served to my husband.

I don't know the laws in the Phillipines. Call the US embassy there or send an email. Whenever I sent an email to the US embassy in CR, they sent me a fast reponse.

Good Luck. Its too bad it has to be such a pain in the A$$ ...

phils law not recognize divorces in phils -

but

if a USC citizen divorced a phils woman IN the usa,

the divorce decree (issued in USA)

could be used to obtain an annulment document IN the Phils.

Use Manny Pacquio as a example.

He's and his wife a PI Citizens

He's has 5 or 50 lovers while in USA.

He is Golden, Wife can't divorce him and if she leaves him she walks away with nothing

It is Great to be a PI Citizen an be a Male...............

Maybe marriage in the Philippines is not recognized in the USA?? Worth calling a family law attorney to find out.

I would cancel the K3 ASAP if not already approved.

You can divorce him in the US but Philippine Gov't won't recognize the divorce if you are the petitioner. Now if you get your husband to be the petitioner then you just need to file in the Philippines for Recognition of Foreign Divorce. If he won't then you'll have to go through the annulment process in the Philippines.

Yes, you can file divorce in the US and you can re-marry in the US but cannot remarry in the Philippines without filing for annulment.

As Bob 4 Anna said, if your husband initiates divorce, you can use that to file for Judicial Recognition of Foreign Divorce Decree in the Philippines, and you can remarry in the Philippines without filing annulment which is more expensive.
