i arrived to the US with k3 visa, and i have told in the airport when they admitted me, that i should wait for my GC, and they gave me 2 years staying and since that time i'm here waiting and there is nothing, and i'm totally lost, because i can't work at all, i just want to say that, i did applied for I 130 and I 129 and both are get approved in 2009 june, they have been approved even before i come here.

now i'm setting here with my wife i don't know what to do or even where to go! .. i can't afford a lawyer, i just need help anyone tells me what to do!, should i have to applay for the adjustment of status! which is 1010$ this is really too much, and i don't want to do it before i ask and get advice. if there is any other way!

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

The K-3 is just a visa to come here. Every K-1 and K-3 must apply for an Adjustment of Status, the visa does not come with a green card automatically. You should have done that pretty soon after you entered the county and before your K-3 expires.

OP, You are another exception, getting K-3 visa (non-immigrant visa) rather than IR1/CR1 (immigrant visa). This again shows K3 is still an open path.

You need to adjust the status from non-immigrant to immigrant by reading the above link. Yes, since you pursued the K3 path, there is no other option to spend some extra money, extra paper work and extra time to get the Green Card.

One benefit I saw in K3 path is {It may be ONLY applicable to the petitioner (example: who graduated from the college just a year before filing K3 visa and got the job recently) who has solid income in the year of K3 visa, but no income in the previous years} - Petitioner can file I-134 instead of I-864 Affidavit of Support where I-134 is more easy to get approved. Then, they can file I-864 with the Adjustment of Status, say a year after arrival of the beneficiary (K-3 will be valid normally for 2 years). By the time, petitioner is all set with his income in the current and last year and they are all set for Green Card as well. This solution will be applicable to only few people like in the above example.

Your I-130 is approved. Now do the Adjustment of Status by filing I-485.

With I-485 AOS, you will submit I-765 which is the petition for Employment Authorization Document (EAD). Typically it will take upto 90 days to get EAD. With EAD, you can start work in the U.S.

You already passed NVC stage and forget about NVC now. NVC is history now :star:

i'm terribly sorry, the K-3 , to 'get a greencard' requires an Adjustment of Status case to be filed. If you follow that guide, and are meticulous with your paperwork, no attorney needed. VisaJourney is a GREAT DIY Immigration Portal, with an Emphasis on 'Y' and 'D'...

Thank you, but i would like to note that, my I 130 and I 129, both are apporved in june 2009, even before i get here, and they gave me a k3 visa in the embassy, now i'm going for the AOS, i'm just afraid about the time, does it going to take so long time, i can't work at all i have no SSN, i'm totally freezed and setting at home, me and my wife feel so sad.

It's NECESSARY that your're approved your I-130 & I-129 before you move! You need that to be into the US. Once you're here you MUST file for AOS! Yes it is $1010 and you also need to see another civil surgeon to get your vaccinations transcribed onto a form that's part of the AOS guide.

It usually takes 4-6 months to get a green card. You may apply for a SSN but it'll be stamped on it that you can't work without authorization. (Applying for an SSN is free and usually arrives in 2 weeks- visit your closes SSN Office)

Also, when you apply for AOS also apply at the SAME time for your EAD ....this allows you to work while you wait for your green card. The EAD usually only takes 2-3 months to process!

The sooner you get your AOS & EAD filed the sooner you'll be able to work! Please follow the guide that was given above exactly to what it says and you'll be fine!---it was posted by "Bobby+Umit"

why to be afraid about the time?

to 'get an I-129F in the pipe',

someone filed an I-130 on yer behalf.

To get a K-3 visa, the I-129F must have been approved.

It doesn't matter , now, that you have an approved K-3 visa.

What does matter, is IF you'd like a greencard !!!

Would you like a green card? Please file the AOS packet, pay yer fees when filing.

As to 'what you can do or not do' - ya, sorry, that's common knowledge. IF yer just discovering it, I'm terribly sorry, this really sucks, right? Can't work, can't get SSN, can't really participate monetarily in yer spouse's household.

File yer stuff, and wait. Those before you, did the same thing. If you and yer wife are truly feeling sad, then re-examine WHY she not continue with NVC processing on the I-130, ages past.
