Ok, here the next question. I had read the FAQ here regarding the bank statement for the affidavit of support and thought we would be fine having a letter stating Name, date of opening the account and current balance. Now i re-read the instructions for I134 and there it said that it would also have to state the transactions of the last year.

Is that really a must have?? Or are our statements already sufficient? Its just we got them today and it would be great we could already send our stuff in to get the interview appointment soon.

Any experiences? Thanks for your help.

Are you using assets (bank account) to cover the income level needed?

If not, you only need to prove current job/income level - letter from your employer. (that one of the options for the I-134)

Some embassies require one year worth (current tax year) of tax info (IRS tax transcripts are the best) to go along with the I-134 - you would need to check with them for the particulars.

If you do need assets from the bank - the letter has to be written by a bank official.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

We wanted to hand in a letter from the employer of his mother (she is our co-sponsor and has sufficient income for sponsoring me), bank statements and tax information.

So i guess since we provide all those 3 things we should be fine if the bank statement is missing the last year information?

i have a question about this, i just started a job in march where i get paid pretty well, when i get my W2 at the end of January is it good enough? or what do i have to do?,, i have a W2 from 08 where i worked at a voluntary fire department, and before that i worked 10 months at a welding shop un till it closed (due to the economy) the time in between i did not have work also due to the economy. but now i have a good steady long term job, and also when do i have to present this?

My income is only 3,000 dollars more than what is required for 125% poverty guidelines. Do you recommend I get an employment letter from my par time job which add another 6,000 to 9,000 dollars to my gross income.

You would need to prove your present income, and provide any past tax info if required.

I-134 requirements are different than the 864 - the 134 is handed in at the time of the interview at the embassy (again, check with the one your going to for what they need for it), the 864 is handed in with the AOS, and they require the current years tax info. (in this case 2009). You can had 3 years worth (2007, 2008, 2009) if you think it will help your case.

If your last years income didn't cover the level needed, but you are making that amount now, you would have to prove it, with pay stubs (6 weeks or so), and a letter from the employer. (can be used for the 134 and 864)

If you didn't file taxes for 2009, you will have to make a statement of why, and referencing the IRS instruction that allows you to do that. (more related to the 864, but can be asked for with the 134).

My income was fine to meet the requirements and therefore I included nothing from my bank. I included three years of free IRS tax transcripts, a letter from my employer, and about two months of recent paycheck summaries. No issues.

This relates to a question I have as well. I make 43k (no dependents) and have had the same full-time job for 4 years. Do you think I need to provide bank statements as well? My bank account balance is usually pretty sad by the time my bills go through and I don't intend on including this on my form (if I don't have to) since I don't have much savings (especailly with a wedding, visa fees, Christmas and a transatlantic plane ticket coming up). My bank statements wouldn't help my case whatsoever.

If you direct deposit your paycheck or even if you deposit your check every payday, one of the things that the bank letter will show is the amount that you have deposited over the past year...Should be all of your paycheck minus the deductions. I was amazed at how much money I went through in a year.

Right, but isn't part of the bank statement letter your ending balance? Mine's going to say something like "Total deposited: $36,000 Total ending balance: $4.50". My concern is the balance, not the deposits. I'm afraid they'll look at my pathetic finances and deem me unworthy to support him.

And another thing. He has a lot of savings. I don't understand why that doesn't count for anything, not to mention his currency is worth more! I don't get why they only look at my finances when he can prove he has money as well.

Savings can count - they are assets. (if you using them as a non-spouse, they consider them at 5x the level needed, 3x for spouse/children - this is 864 related)

Since this is for the K-1 I-134 most likely, they look at income mostly, but assets can count. In most cases they will use the same guidance as the 864 - depending on the embassy in question.

For example, some need the 100% level for the I-134, however, since they know your coming to the US to become an immigrant, they want to see 125%. (since you will need the 864 eventually)

But if your income is enough to make the level - then you do not need assets.

However, you need to check with the embassy your going through. Some are tougher than others. If you are close to the level, they may want more - some are ok with the exact poverty level needed.

Read up on the embassy in question - and get a feel for what they are looking for.

Well I am the US citizen, he has the savings. My income is more than enough for the requirements, but I'm worried they'll look at my sad bank account balance (I have loads of debt and bills) to make their decision. I'm told they don't do a credit check or take debt into consideration, but I'm still worried nevertheless. The embassy he's going through is London.

If you make 43,000, you don't need to provide any information on assets or bank accounts at all.
