Wow, how heartbreaking! My wife and I met 15 months ago in China. Ten (yes,10!!) trips to China and 150,000 flown miles later, We found ourselves at the embassy in Guangxuopost-80216-096595500 1283049688_thumb.jpg for her interview. As you can imagine, we had hundreds of photos, receipts, etc. as evidence that our relationship was legitimate. We even had a wedding ceremony this past february in her hometown. I even lived with her last summer in Shenzhen.

The interviewer was incredibly RUDE and gave her less than 3 minutes of his time. He barely looked at a little of the mountain of evidence and denied her with a "blue" form. He told her that she needed phone records and that was all we were missing.

This sounds like total BS to me. Had he spent three minutes with both of us ( I was waiting downstairs! ) he would have easily seen that ours was a legitimate union. After talking to many people ( including her friends, all of whom were passed with barely a thought! ), we were told that maybe our age difference (she is 29, I am 48) was a factor in the denial. My greatest worry is that this man was not being truthful and has no intention of approving us. As you can see by the photo, neither one of us appears our age. Anybody have any thoughts/comments/suggestions would be greatly appreciated.

Was it really denied? From what I know a blue slip means that you just need to pass some missing paperworks or from what you've said just copies of phone records. In Manila there has been cases of blue slips that still got a K1 approved visa after submitting what the embassy wanted.

Thanks. what may save us is that I used the same RECHARGEABLE calling card since day one. I called the card company and sure enough, they are emailing all the records to me. I hope Im not just wasting my time. she moved to her hometown to stay with her parents and wait this out.

Please see the highlighted... if true and legal then it is no wonder you have problems getting a FIANCE(E) visa....

First, I am really sorry about your blue, but a blue is not a denial, it is a request for further evidence of bonafide relationship. What I raise as a potential redflag in your case is the mention of the wedding ceremony you held in China. Did this evidence come up during the interview?? You can not file a K1 and then have a wedding ceremony, it will invalidate your status as an engaged couple and require a resubmission as a spousal visa. So, they only asked for more phone records??

like other poster said, sounds like you weren't denied but that you need to supply more paperwork...

what i dont understand... you are married but filed a K-1?

if you gave your info (receipt #s, full name, etc) to anyone on VJ under the guise that they would "help" you through the immigration journey with his inside contacts (like his sister at USCIS) ... please contact OLUInquiries@dhs.gov, and go to http://www.whitehouse.gov/contact to report anything suspicious. Contact your congressman and senator's offices as well.

I am sorry I did not clarify....our wedding was a CEREMONY only that we had for several reasons. One, her grandfather was about to pass away from cancer, and another being the timing would allow many relatives to be there. We did not file any paperwork.

Sounds to me your ceremony was like an engagement ceremony and I know in my husbands country they have those a lot and I would have mentioned it and showed those pictures as proof of your commitment and dedication to your relationship.

It sounds like once you turn in those phone records they will process your case and give you a visa decision.

OP, Sounds like you are a case for needing a good immigration Atty, so consider that.

Re Phone Records: Guys, you really should have some. If you have to make a % of your calls at greater expense for the sake of getting phone records, then you MUST do this.

If you can use SKYPE with your girl for FREE, then do that and DL the SKYPE phone records.

When guys use a CHEAP phone card that gives you no phone records, then you are not giving yourself credit and evidence of your relationship. Pay up for awhile if ya have to and get those phone records!

With Skype you can go to your account page and do a screen shot. It states on there your name and your user name and your email address. This should be enough for them to see that the skype records you turn is is actually you in my opinion. Of course it is secondary evidence but it still shows proof of an ongoing relationship.

Make sure you do not mention this at the second interview, if there is one. If this comes up, be sure to mention it's an "engagement ceremony"! Also call yourselves other endearing names, even fiance(e) in front of the officer, not husband/wife. This is a trap that many fall into and there have been cases of denial based on this only.

Subscribing to what everyone already said, your case was not denied...Keep calm and provide all the extra proofs they might need. Best of luck! :thumbs:

FYI: Skype records mean NOTHING to the interviewer. This is because you cannot prove your identity by a user ID. They want records that can be verified.

Be sure to have a Skype user name that is inclusive of your real name. If you don;t belive Skype is good enough for validation, then step it up and use a long distance service connected to your residence. It's not rocket science. Good luck and get going!
