Hello? Good Day to all VJ members ! I just want to know, is it ok to apply for food stamps? My husband got laid off from his job :( and I got my conditional resident card :) Is collecting food stamps considered as a public charge?

(based on what it is written on Affidavit of Support I-864). Please give me a better understanding on this.

Thanks for the response. :)

Is collecting food stamps considered as a public charge?

for green-card-holder, yes.

for USC, no.

He, the USC can collect food stamps not using you as a dependent. In other words if it is just the two of you in the household he would be considered a household of one. Food stamps are a means tested benefit for which you are not eligible for five years after receiving your green card.

Someone correct me if I am wrong.

Even uglier, if the non USC is working the income counts the person doesn't , So if your income is too high to qualify as a household of 1 then he can't get food stamps

This will not be over quickly. You will not enjoy this.

Your husband can file and recieved food stamps, and his wife you can not received food stamps. In I-864 your husband swore to support you...Hope everything will be alright.

I just want to add a bit more to the line of though for food stamps in general. I have a fully disabled room mate. Her food stamp income is about $30.00 a month for 1 person.

It might be in your interest to look for a local church who has food bank nights who can help you out. Also, your Husband can go to the local unemployment office and collect money from there to keep you from starving. It's absolutely time to cut back on the non-necessities, and buckle down while he looks for a new job!

Good luck and I hope this is resolved for you quickly!
