Proxy Marriage

Hi, I had my interview in march, and after the interview my husband was put under AP. We provided various proofs of vaild relationship Texts, Letters, webcam photos, Yahoo screencaps, Pictures of us when I visited, Photos of our wedding, and photos of me with his family, ECT. Now the problem is that when we did the "paper" wedding the legal one I was not there, there for was unable to sign the marriage license myself and had to have a proxy (My Uncle) sign the contract on my behalf so is this a problem? could this be the reason that my husband was put under AP and its been so long and we have gotten no new information. I mean could we be denied because of this? or would they have denied us at the time of the interview IF the proxy was a problem?

During the time that we got "married by paper" I could not go over there because of financial problems, and could not afford to travel, but after a couple of months when my frantical situation got better I was able to travel and we were able to have our marriage ceremony, is that enough or is my being unable to appear before the shehk and sign my marriage contract make my case void? all help is appreciated.

there are some countries and regions of the world, where a proxy marriage is recognized by the US Embassy in 'that' Country, as a legal marriage - if all the rest of the legal marriage paperwork is stellar.

I'm thinking it might help ANYONE ELSE who reads this topic of yours -

if you'd please TELL US, IN WHICH COUNTRY the marriage took place...

Unless the marriage has been consumated ( you have had sex after the marriage) the marriage isn't usually considered valid for immigration purposes.

If the proxy marriage was considered valid at the point(s) where it occurred and consummated after the marriage then it has been accepted by USCIS.

Your proxy marriage was most likely recognized since you did travel later and (I assume) consummate the marriage. AP is not uncommon for a person from the middle east, there is a whole thread for this topic. See if he remembers what he was told at the interview, usually something along the lines of "your visa has been approved but we require some additional processing".

One of the real keys is was your marriage consummated before you filed ? If not you weren't married and they will deny you. Also does your state recognize proxy marriages ? You will probably spend a little extra time in AP while they check out the dates of everything

it is recognized were i got married which is palestine, but not were i like in the usa.

well idk they told my husband on his interview that everything was great and that they only needed to do ap. But now that i think about it if proxy marrige is reconized in the country were we got married but not in the state we will be living in we will have problems with AOS correct.

I wouldn't worry too much about the AP, if they told your husband that everything was ok after the interview. AP, sometimes long periods of AP, are pretty standard in Middle Eastern countries. As for you having difficulty with AOS- with AOS, you're dealing with a Federal agency, and if they recognize your marriage enough to give him a visa, you should be ok at AOS.. I'm sure someone will correct me if my assumption is incorrect.

Proxy marriages are always something that slows things up a bit while they figure out in their eyes if you are really married. The fact it isn't recognized in your state may cause an issue. Foreign marriages are fine because you are both in country X and county X recognizes the process. This issue with proxy marriages is kind of like porn. If you are in place A and it is legal there , but I am in place B and it isn't legal, has anyone done something wrong ? Hopefully it works out in your favor.

No. Wrong. is no AOS for a CR-1 visa.

A Proxy Marriage in Palestine is fine - you have no issues about it. It's something else, truly.

as far as 'idk' -

I'm strongly suggesting that you FIND OUT. Call the DoS Hotline # (# in my profile), get a Human, inquire for casefile status, ask why he's still in 'additional processing' and ask why he was put in 'additional processing' in the first place.

AP in Palestine normally is focused on additional namechecks - and NOTHING ELSE - so this concept of 'you worrying about a valid marriage' is bullcrap, IMO - if there was any issue about 'valid marriage' - he would have been told, on interview day: 'The USA cannot recognize your marriage. If your petitioner returns, and has a legal marriage ceremony, you can re-apply later'. So - he wasn't told those words, on interview day.

THE AP IS FOR SOMETHING ELSE. You really need to find out what's going on - call the DoS Hotline, get a Human.
