My fiance went to his visa interview today in CDJ. The officer told him everything was fine but he would need a waiver. She directed him to the DHL window. HE paid the dhl fee and they told him not to leave Juarez until he receives the his things. My question is this: "DO THEY KEEP YOUR PASSPORT WHEN THEY DENY YOU"?Please I hope someone can help us. We will really appreciate any help someone may have. We await a response. Please.

'needing a waiver' does not equal 'denial'.

Paying a dhl fee is not related to filing the waiver.

I'd be more concerned about filing the waiver than anything else .

Of course, if they kept the passport, it's a good sign they have intentions to finally approve the visa.

What's the status on filing the waiver?

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

He says the consulate officer told him they'll send him the instructions for the waiver and the rest of his evidence thru dhl with his passport. He needs a waiver because he overstayed by 3yrs. He went back to Mx on his own. He's been there now for 1yr 7mos 2wks. It's been a long wait but we believe doing it right and honest is always the best way to go.Now we would like to know:How long is the wait between the visa interview and the waiver interview?

US Embassy and Consulate Discussion

This is the place to post your experiences or questions related to this last step before moving to the US. Topics relating to I-134's, packets sent from consulate and medical & police certificates should be posted here.

YMMV

Yes, they will keep his passport and it will be returned when you go to the DHL office for your package, it usually takes 2-5 business days to arrive. I noticed that the consulate in CDJ has closed on Friday, I hope it doesn't delay thigs for you. My fiance needed a waiver and it was just approved after being backlogged for a year. You find much more useful information at www.immigrate2us.net regarding the waiver and also more compassionate people than you will find on here. I don't see why someone felt it was neccesary to move this post since you were still in the interview stage and your question was still relivant to the fiance forum.

We would like to thank all of you for your help. It has been a long journey and my fiance and I still have a long way to go but we also realize how far we have come. This site has really been a blessing. It has been a guide. I thank all of you for your time and support. I hope that my experience will benefit others.

I have another concern: He picked up his packet from dhl in CDJ but his passport and evidence weren't in it. The only thing the packet contained were his waiver instructions. Is this procedure?

yikes - it may be (guessing 20 percent chance here) that they are thinking to 'fast track' the waiver, hence keeping the passport and evidence pile. Hard to say.

Good Luck with filing the waiver, hope it all works out ! FWIW, review all you can over at http://www.immigrate2us.net - they focus LOADS on waivers and waiver-related casefiles.
