Hello all, I just had this thought run through my head the other day...the original packet for K1 Fiance Visa is showing my wife's Maiden name since we weren't married yet and now that we are married she will have my last name. Do we now start filling in her NEW name automatically on every AOS form? Doesn't this cause confusion? Or do they not have a way to see the K1 packet and her maiden name? I'm confused..how would they know it's the same person? Just by us including the Certified Marriage copy?

Her last name will change to mine but she has a middle name (Liliana) and a first name (Niculina). She wants to drop her Niculina and use Liliana as her first name since everyone knows her by that and noone ever calls her Niculina. Would that be ok for us to just flip her name around as we please?

And also I see people talking about some kind of time period when you can apply for SSN or until they have you in their system...what is that?

And last thing, why do I see people mention 3 packets? One for AOS, one for EAD and one for AP if I plan to send them all together? Does each from require its own packet?

Did she have to sign the marriage license in her married name? Either way, that's the proof that you're married and if she wants to change her name, she can use her marriage certificate. Whatever name she wants to use, she fills out all of the AOS forms using that name. It will work for changing the last name, and I'm pretty sure it will work of she also wants to change her first name. If I'm wrong there, someone will correct me. USCIS knows that if she's here on K1 visa that she has to adjust status based on marriage and that possibly she will be changing her name. No worries there

She should have applied for SSN before you got married because now that you're married I'm not sure if they will let her. She can only apply up to 15 days ( I think, it may be a different number of days) before her I94 expires. Once it expires, she'll have to wait for her green card to apply

She puts her married name on the forms if thats the name she is planning to use. Whatever last name she puts on the AOS application is going to be the name on her green card. All 3 applications get filed together in one envelope. No need to send a different one for AOS/EAD/AP. They will know its the same person...you are sending in the marriage certificate, it asks for name EXACTLY as it appears on her I-94 (which would be in her maiden name), her A# etc.

As for changing around her first and middle names...I dont think that would an option. Changing your name like that would usually require a court order, its alot different then taking your husbands last name.

She can change her entire name DEPENDING on the type of marriage licence she has. in iowa it has name BEFORE and name AFTER marriage listed. If she has a standard one then no, she cannot change her first name or middle name unless she gets a court order. The marriage licence ONLY changes the last name unless otherwise specified like the Iowa licence does.

Trust me when I say this. There was another girl recently from the Philippines going for naturalisation. She completed the AOS forms, and ROC forms using a new name and didn't have a problem, but when she got to the naturalisation part they said she would need to show proof of her legal middle name change as her marriage certificate only changes her last one. She had all her cards including bank, drivers licence, SSN etc in the name she'd made up and had to get it ALL changed back to her REAL legal name... so check your state requirements.

the marriage application which we signed in front of the judge, she HAD to fill in and sign with her Maiden name, that's what the judge said and then if you want the last name changed, that will be done once we get our Certified Copy

after a 10 minute debate with the wife, it has been written in stone that she will keep her middle and first name as-is and only change her last name, it is the most logical thing to do otherwise this whole name fiasco will cause Earth's axis to shift another 3 degrees ;)

Yep. Sounds like your states licence is a "last name only" changing document. sorry!

If she REALLY wants to change it, there is still hope. if she plans to naturalise she can apply to change her name then and they will do it for her. Have a look at form N-400 and you will see on page 1 I believe it is where it asks about whether you want to do a name change. It means waiting a couple of years of course, but she can decide when and if she applies for Naturalisation if she still wants to change her name. it will be MUCH easier then :D
