Petty crime and lesser offenses usually result in detention pending deportation for illegals once confirmed. I see no concern to allow the minority of cases that are hyperventilated here to set a hysterical pace in ignoring actual context, but this is nothing new.

Osama wouldn't get bail because he'd be labeled an enemy combatant under Geneva Conventions and not subject to the constitution and laws of the United States.

What's interesting for me is folks always want to apply constitutional rights to criminals (yes, they're ALL criminals) who are illegally in this country yet will not make the distinction between citizens who are protected by the constitution and illegals who are not. For some reason, folks want to GIVE rights to illegal criminals that they don't necessarily have.

You can't assault one or steal from one because they have rights. They have rights because it's self evident that all men are created equal.

An American is not some sort of super being who can treat non citizens anywhere exactly as they wish and inflict anything on them with impunity. You can't even do that to a dog or cat without being prosecuted.

Slavery has gone, the Geneva convention has arrived and so has the 14th amendment and a million US laws. Sorry but your targets are protected from what you would like to do to them..

Maybe the more psychotic could convene a constitutional convention to strip non-citizens of any constitutional rights, being that most of the intent and reasonable interpretations under more egalitarian human rights principles exist to extend all peoples the blessings and liberties of such a document. Some folks have a hard time understanding that the US Constitution is not merely a set of interpreted directives but rather a very nice and powerful collection of principles that has- in theory- shaped the concept that is the United States of America.
