Well, basically, me and my fiance have been together over a year...we met in person in the UK (I'm american but I'm legally allowed to be here). We live together and have for the past 6 months, but now I want nothing more then to go home to California. He'd also like to live there having visited in Dec with me for 2 weeks right before we moved in with each other. My question is...if I want to apply for a fiance visa so I can get married at home, how do I go about doing so?? Am I allowed to apply for the K1 without being in the US..and if so...what happens when I need to show that I can support my fiance?? Im just a bit confused because it seems that everyone is seperated while applying...and seeing as it takes so long ...we wanted to make sure that being seperated for however long it was...isnt the case..help!?

Well I am not an expert on this, but from your post it sounds like you are in UK for atleast past 6 months. If that is the case you maybe able to do a Direct Counsalar Filling. That should not seperate you guys. DCF usually goes really fast. I think less than 2 months. But like I said I am a total newbie in this whole thing also.

Somebody can correct me on this If I am wrong.

But don't loose hope. We got tons of real experienced people here ready to help you.

If you were to go about this via DCF (explained above) you would need to get married first. You cannot do DCF for the K1 fiance visa route.

Met: December 2009

Doesn't a foreigner wanting to get married in the UK to a UK National need special permission or Visa?

It's the same there as it is here. Americans do need a visa to be in the UK if they are doing more than just visiting, and they have work visa's, fiance visas, spousal visas, all just like the USA. But the OP is saying that she was already in the UK legally, so there is really no reason to have to get another visa to the UK, as she also said she's a dual national which means she never needs a visa. But she is trying to get information about them both coming to the USA.

To the OP: Unless you want to get married in the UK, you are more likely to have to be separated as DCF isn't allowed. The main problem is one you bring up of the affidavit of support. You will be his main sponsor, even if you aren't working. I would suggest trying to find a co-sponsor in the USA that is willing to provide proof that your fiance won't become a public burden.

well my mom and all my family are currently in california...so if one of them were to agree to be a co sponser..would that be alright?? if i just apply for the K1 fiance visa..and send it to cali and then wait for it to get sent back and all that..would it be enough to have my mom sponsering him..or would it cause problems when we got to the point were the financial info was required because i wouldnt have a job there?

Yes, you could have a family member co-sponsor. If you look through the guides, you can probably find out more information on co-sponsors. I don't want to lead you in the wrong direction. But do remember that any co-sponsor would have to make enough money to support all of the dependents they already claim, plus your fiance. You might want to take a look at the poverty guidelines to get an idea about how much money that is.

I had no problem applying abroad. I just used my parents address when a US address was required. Best wishes.
