What would this person have to do to qualify through US Immigration and National Visa

Center to obtain a Visa for his fianc'e?

Center to obtain a Visa for his fianc'e?

He can still file i130 as long as they get a sponsor for the NVC stage.

CR-1 -- California Service Center -- Mumbai Consulate, India

16th March 2010: I130 sent
25th March 2010: NOA1 Received
23rd July 2010: I130 Approved
Your I-130 was approved in 120 days from your NOA1 date.

30th July 2010: NVC Received
14th Sept 2010: Case complete at NVC
22nd Oct 2010: Interview date assigned
19th Nov 2010: Interview at 7:30 A.M IST APPROVED

Passport with visa in hand on the same day.

N400 Sent: 31st Oct 2013

NOA1: Nov 4th 2013

Letter for Biometrics recievied with Appt on 12/09/2013: Nov 18th 2013

Biometrics done: Nov 22nd 2013

Hello, yeah he need to file 1-129f and need to find co-sponsor, like mine my husband don't have job and his Mom our co-sponsor, we are now in the middle of processing..

not filed any petition yet, right ?

IMO -

can file the I-129F immediately, then bust his @ss during the next 8 months to either:

--make a bunch of money or

--secure a joint-sponser/co-sponser

His finances are not evaluated until actual INTERVEW DAY at Guangzhou IV, with a 'look-see' at the I-134.

Some ppl may think this is a gamble, others not.

Tell Him to Get Busy, regardless !!

If in fact, it IS a CR-1 - then his financials are reviewed at NVC, figure 6 to 7 months after initial I-130 submittal (sometimes 4 to 5 months, so be warned)

Which is it? CR-1 or K-1 ? I-130 or I-129F ? Pick one or the other - one has a spouse, the other a fiance.

Do you know if this is true for all embassies in all countries? We're doing a CR-1 and from reading forums I'm now confused as to at which stage (NVC or embassy) the I-864 is really delved into. Is it both?

I-864 is NOT I-134, sorry.

I-864 used for CR-1, I-134 used for K-1 and K-3 visas.

I-864 examined twice, once at NVC for 'completeness' and 'make the cut' -

then again at the Embassy, deeply...

The OP used 'fiance' in a sentence, but CR-1 as part of the topic, so I'm a bit confused as to what is being filed for -

but I wrote about both I-864 and I-134, just in case.

NVC just arranges your papers and makes sure everything is in order, nothing is missing, etc.

It is evaluated on interview day by the CO who takes into account the 'totality of the circumstances' -- he/she has the final say.

But wait... if the visa is denied at the interview based solely on the lack of proper AOS, what happens then? Do you get a chance to mail them a new set of forms and have it reevaluated then, or do you have to get back in line for a whole new interview?

--Always a good feeling. :)

--Usually it is not 'denied' for the AOS, maybe only temporarily. You're given a chance to rectify it and you will be asked to submit a new set of I-864 or I-864A, or supporting documentation. Usually, you can mail it or fax it in.
