Have any of you heard of a couple with children together and still happily married (no divorce, no problems, no waivers) being told they don't have enough evidence to remove conditions? My husband and I have a 2 year old daughter, she was born in Lebanon but she's a U.S. citizen, the embassy issued her a birth certificate. I am also 6 months pregnant with the baby due October 11th. We didn't send in a huge packet only very basic things as evidence like lease, birth certificate for our daughter, ultrasound pictures from the hospital, 2 years of joint tax returns, and insurance.

Normally, USCIS will send an RFE requesting additional evidence. They sometimes list specific items they want or they just ask if you have anything else to add to what you have submitted already.

Did you hear back from them or you are only wondering?

The only thing I have received is the NOA with the same date as the day they received the I-751 petition from us. I am worried we will be picked on because I am 8 years older than my husband, but you would never notice that if you met us so hopefully they would just do an interview if they have suspicions.

If that is your only fear, then there is nothing to worry about. If you are still married and living together and are able to produce evidence of such living, then you are already on their "good-side". Having children will only enforce such relations and will make it easier for you to be approved.

This process takes time, so you should be waiting for a biometrics, then the approval letters....

I am surprised they asked for more evidence despite the fact that you are living together and have 2 kids. I remember, when I filed for the I-130, there was no activity for 6 months. I sent in the ultra-sound picture for my daughter when we found out that my wife was pregnant and was approved within 2 weeks. Even the IO at the AOS interview didn't ask for much related to our marriage once she saw that we are about to have a baby. Whatever evidence you have submitted is about all the evidence I plan on submitting, alongwith my daugthers birth Certificate. I am sure you'll be fine. Don't worry too much about it. You child's Birth certificate alone is worth a truck load of evidence. Good Luck.

That would be very unusual. But, as I like to say, nothing is unimpossible. Now let me close with a guess: you sent in your N-751 package and are waking up at night, worried if it will go through smoothly?

Why are they taking so long for you? I have been looking all over the internet and most people get approved in 3 or 4 months. I hope you get an approval notice soon, good luck.

But why do they do not believe so much in the babies because I think it is the biggest proof of a good marriege, I dont think someone will have a baby with someone that do not love or like, just to get a GC, all marries with good base will have babies.

I dont think someone will have a baby with someone that do not love or like, just to get a GC, all marries with good base will have babies.

Do you really belive this?
