Today I checked the online status on my case (Like I do almost every day) and found out that my I485 has being denied on April 26, 2010. I still don't get the letter that explains why we were denied. and it's pretty much a shock because after our Congressman worked on our case because of the RFE sent to us. We got a letter from Jerry Lewis on March 22nd saying that " I'm glad to inform that your I485 has being marked ready for interview scheduling" he also said on the same letter that my I-765 was approved, and that the permit was going to be mailed in 10-15 days.

A week after that letter, while checking the status online,I found that both forms ( Interview notice and Job permit) were returned as undeliverable by the post office. I call the same day to see what was wrong with our address, and I think somehow they send it to our physical address instead of our P.O Box; so after fixing that, I got my Job permit on April 12th

Since I got the Job permit I assume it was going to be a matter of days before the interview notice came, but nothing, and since the guy I talk to said I should only call again after 45 days, I decided not to worry --- BIG MISTAKE! :(

Now we want to call the congressman again to see what we can do, but we don't even know the reason why they deny us. How can we know that? Do I have to call USCIS? Can the congressman get that? Do I have to appeal? We don't know what to do, please help us! :crying:

ouch. ya really need to get that address thing sorted out, time is of the essence.

I don't have 'the right thing' to tell ya, here, at all - except

to keep calling, ask for supervisor each time, and hopefully you'll get a smart enough supervisor that can see and correct this mistake. But - keep calling. Call every day about this. A record is made of each call, so at some point, with 10 calls on the same problem with no resolution, you MIGHT get some escalation - but that's just an idea coming straight out of my backside.

The Congressman's immigration liason staffer SHOULD be able to dig into this, as well, in a timely fashion.

Finally, you can set up an infopass appointment, and hopefully get a human , face to face, that can fix this for you.

Is it possible your interview letter was sent out and since you did not receive it, you missed the interview date? Just a thought if you were already approved for EAD it seems likely they would at least give you an interview before denying. Like was said before keep calling, make infopass appointment, whatever you can do to keep it from proceeding further with denial steps.

This happened to us too..because of all the address change..I think that might be what happened to you. What we did was we scheduled an infopass at our local office and they were able to locate our files. We just had an interview and got approved. I suggest you do that too..=)

Thank you for the help, Now I *just* tried to get an InfoPass but the only options to get one are this 4:

1 - Order from Immigration Court - If you were directed to us for processing based on an order from the Immigration Judge. You must bring all documents required in the post order instructions given to you by the court.

2 - Case Processing Appointment - If you received a notice to go to your local office for further case processing.

3 - EAD inquiry appointment - If your I-765 employment authorization application has been pending for more than 90 days.

4 - Case Services follow-up appointment - If it has been over 45 days since you contacted NCSC and have not received a response to your inquiry. You must bring the Service Request ID Number related to your inquiry to the appointment.

None of them apply to us, and i don't want to lie to get the InfoPass, We were thinking abut just saying Number 2 but it does say "In case you received a notice to go to your local office for further case processing" Would it be bad to do that? would they even know it?

It doesn't matter what you checked on that.You just need that paper to be able to enter the building. Me and my husband made a few appointments and I checked whatever I wanted (I was there to discuss about a denial too and to show them my approved waiver from the Department of state which is not an option there either).

I hope that everything will be ok with your case but you have to go there immediately because if you don't they will start the removal proceedings...I know that because the lady that we talked to actually went and checked my file and wrote something that I have the J1 waiver approved and stopped the removal...

I am so sorry about your situation!Like the other people said - just do infopasses and call your senator/congressman. Don't call that 1-800 number, it is helpless. Good luck!

We got a letter saying that the case was REOPEN! but no interview date yet.

At the interview the lady said that I was on the pile of cases for deportation and if we didn't file a notion to reopen soon I had a good chance to be deported. We did as soon as we got home and now to wait again and see when they will give us the interview appointment =)
