Why are people advising others that the K3 is obsolete?

I just disagree with you on this pushbrk. I will let you know what happens with my visa. I should get a NOA2 end of Aug.

It's really not a matter of disagreeing with me. You're stated intentions don't fit the realities on the ground. NVC's new policy is THEIR new policy and they have been consistent with it so far. How do you think you'll influence them to handle your case in a way not consistent with their current stated policies? How will you successfully "disagree" with NVC. Unless you have a very good answer to that, that we would all love to hear, I suggest you study the CR1 guide and NVC shortcuts in the Wiki, in preparation for what will REALLY happen.

WOW I diden't say I disagree with NVC. I said I disagree with you on the fact that they will close my 129f. Lets just wate and see how my visa process goes.

Daboys, This thread is still active cuz it says **********"IF"********** 129F and I-130 Petitions Approved and Received Together they will close the 129F. If the NVC does not receive an ******"approved I-130"***** petition and I-129F at the same time, the NVC will process the I-129F petition. So let the 130 die so they prosses the 129F.

That is all I can say. I will let you know the outcome in a few months.

Exactly. Also, I think Brian is unaware that with only very rare exception, the two petitions have arrived at NVC the same day routinely for about three years. This is... WHY... NVC decided to stop processing both petitions. Brian also only selectively read the posts in this thread. Otherwise he would understand what the rest of us do.

Approved I-130 petitions actually don't die. In previous K3 cases most become the basis by which AOS applications by K3 visa holders were approved. Now that K3 is effectively dead, they become the only viable path to a spouse visa.

My interpretation is that your preferred method is to bury your head in the sand. After your I-129F filing causes your I-130 to lose its place in line, it will be approved the same day as your I-130, arrive at NVC the same day as the I-130 and then be administratively closed. If you don't prepare for this result by having the papers ready to take the NVC shortcuts for CR1, your CR1 will be further delayed by your lack of preparation. That's actually the point of this discussion, to help you avoid unnecessary delays, not to argue with you or be disagreeable.

If the situation isn't clear now, it's not likely to be until official notification is received. I promise that as soon as anybody manages to get another I-129F for spouse through NVC to a US Consulate abroad, we'll be discussing that at length too. Things do change but don't hold your breath on this one.

Unless the option to file 129F(K3) is totally withdrawn by USCIS, there is nothing to say for sure that NVC will not change it's policies about K3 visa in future. The way the K3 was processed has changed quite a number of times in the past at NVC so I am not going to be suprised if NVC changes it policy about the Feb 1st notice about not processing K3 if it receives an approved I-130 concurrently.

In the above OP(Brian Sloan's) case he has nothing to lose if NVC closes his I-129F. He still has the I-130 option. As long as he immediately filed for his I-129F on receiving his I-130NOA1 , he has not really lost anything just because he has filed his I-129F. It is not like they are saying they are going to stop processing his CR1 just because he filed his I-129F.

9/1/2009: Applied for I-130

9/14/2009: NOA1 for I-130

9/21/2009: NOA1 for I-129F (CSC)

9/25/2009: NOA1 received for I-129F (receipt of mail)

01/08/2010 : Thank you very much Jesus..... NOA 2 129F

01/08/2010 : NOA 2 I-130

01/15/2010 : Embassy gets the approval notice (Awesome..Love K3...so glad we have done K3)

01/20/2010: Embassy schedules interview for K3

02/19/2010: K3 interview over and approved.
