I GOT A NOTICE OF ACTION TODAY FOR A 4 YEAR OLD APPLICATION, I THOUGHT WAS CANCELED.

NOW, HOW (To withdraw or cancel your submitted I 129F )?

ALSO, WILL THIS OLD ONE AFFECT MY WIFE AND I ON OUR 10 MONTH OLD I-130 APPLICATION FOR

HER TO JOIN ME HERE IN AMERICA?

THANKS FOR ANY HELP FOR US ON THIS...

ALSO, FOR A MORE FULL PICTURE OF ALL I HAVE DONE ... NOTE BELOW.

1. I USED THE IMMIGRATION PROJECT OF IL. WHO FILLED OUR I-130 TO THE U.S.C.I.S. LAST JUNE 7TH.

2. I CONTACTED MY CONGRESSMAN ABOUT THE STATUS OF OUR APPLICATION TWICE.

A. THEY SAID WE WOULD GET A NOTICE OF ACTION ON OUR CASE IN JUNE, * IT IS IN THE SECOND STAGE IN THE PROCESS.

B. THEY SAID THE DELAY IS DUE TO EXTENDED BACK GROUND CHECKS FOR MY WIFE.

C. OUR CASE STATUS IS IN, Initial Review... THIS IS THE SECOND PHASE AS I MENTION ABOVE..

E. WE HAVE NOT BEEN ASKED FOR THE THIRD PHASE OF; (Request for Evidence) YET.

I dunno Dave , these things have life-changing consequences.

I have to assume, for the moment, that you never did anything about the prior I-129F petition, and shoved forth with a new I-130 petition.

IMO, since it seems you can't follow things with USCIS, you should really consider moving back to India, and give up any further thought to have yer wife actually immigrate to the USA.

NOW, HOW (To withdraw or cancel your submitted I 129F )?

You have to submit a written request stating as such:

Beneficiary name and date of birth

Petitioner name and date of birth

Case number

To whom it may concern:

I am contacting you to request that the I-129 petition that i submitted with the case number of xxxxxxxx be withdrawn as i no longer wish to pursue this petition.

sign and have notarized..

it must be mailed to the embassy if the petition went to embassy, and it must also be mailed to the nvc as well.. Call nvc to ask the exact address, if i remember correctly when i had to do this it went to new hampshire, but not positive and i dont have a copy of it here in egypt with me, its in my computer back home in the states...

Not necessary to have it notarized. Also send a copy of your letter to the USCIS. Also, a petition cannot be "withdrawn" if it was ever approved.

Include language in letter that says, "Please construe this letter as a request for IMBRA Waiver, if such a waiver is needed for future petition.

Note: D-Bag alert in effect. Be careful.

You can cancel a pending petition. Just send a letter to both the NVC in New Hampshire, and to the US Embassy where the petition was sent. I included in my letter that the reason for cancelling was that I was instead filing an I-130 petition. It took about 60 days to receive notice from the Embassy, which stated that the I-129F petition had been cancelled. They may ask for the reason again at interview, but I wouldn't worry about it too much.
