Hi All,

I arrived in America on the 9th March 2010 and am living in North Carolina.

We are getting married on the 4th June 2010 is that ok? It is within the 90 days!?

What can i get done now while i am in America i.e AOS and all procedures etc?I arrived at JFK and was issued a work permit for 3 months (EAD)About 1 week ago i abtained my social security number. What is the procedure for me from where i am now,what is the next stage?

Any help will make me sleep better

... well a K1 visa is the visa that lets you enter the country with intent to marry. You are already in the country, so need to take a different route. Did you go to the US to marry but on a work permit?

07/17/2014 check cashed by USCIS

10/01/2014 found out we are expecting baby #2 June 2015!

12/15/2014 NOA2

12/30/2014 Case received by NVC

03/23/2015 Received Case and Inv # from NVC after many calls and bogus excuses.

03/24/2015 AOS payment accepted by NVC

04/09/2015 IV payment finally accepted by NVC after the set the wrong fee and took weeks to correct it.

*many more delays thanks to the agency processing my fingers prints to the RCMP and the post office losing our mail*

05/20/2015 Packet sent to NVC via UPS, eta May 28.

06/16/2015 Baby #2 due - homebirth in Scottsdale, AZ

I assume your arrived on and activated your K1 visa. As long as you marry in the 90 days then you will do the AOS process. Please read the guide regarding AOS found in the list under guides, or here: http://www.visajourney.com/content/k1k3aos

If you marry on June 4th then you should make the 90 day window by about 3 days. That's cutting it pretty close.

I read somewhere on this site that the new rules for the I-9 Employment Eligibility Verification pretty much make the temporary EAD's issued at JFK worthless, but I don't know any details about this.

After you get married you'll need to file for adjustment of status (i.e., the green card application). You can file for a regular employment authorization document at the same time. You file for AOS as soon after the marriage as you are able. Technically, you are out of status after the I-94 in your passport expires, and before you send the AOS petition. It's not likely you'd be deported if you had a run-in with ICE, but you'd probably have to produce the marriage certificate to prove your eligibility for a green card. It's a headache you'd probably rather avoid.

So, get married, and then follow the guides here for adjustment of status.

05/01/2013 - Removal of Conditions - APPROVED!
