I filed a spousal visa for my wife in July of 2007 and got all kind of excuses from uscis about the delay and two RFE's. I wrote to my ombudsman last year and again early this year. We got a letter today from a supervisor of the customer assistance office of uscis saying that our petition was denied on Dec. 18, 2009 and that CSC had sent us a letter of denial explaining why we were denied. I never received a letter of denial or any kind of letter like that. I did receive a letter dated December 17, in response to a service request I had done, saying our case was still being processed but no denial letter at all. I went online to see if it said I was really denied, and checked my case status. It said my case was being processed in CSC and I would get a letter when a decision was made. I thought that was strange that it wasn't updated online so I called the uscis service center. The automated voice asked for our petition number and after I gave it, the voice said our case was being processed in California and that was the most recent update available for our case. Unfortunately, I got a customer service represenative that wouldn't give me any help or even tell me if we were denied or not. She finally said she would do a service request to find out and then told me I should hear something in 45 days. AARRGGGGHHHH!!!!! I don't know what to do now. Does anyone know how I can find out if I'm really denied or not. Why would the letter say I'm denied and the web site and customer service center both say it's being processed still? Has anyone ever heard of this happening before? I'm really confused and could use some advice. Thanks!

The only other option I can think of is to call the department of state... 1-202-663-1225. Press 1 and then 0 and you will speak to a human. Have your case number ready.

hi brucelene some time uscis can not update your case in system you wait 15 days after 15 days uscis update your case in own system first of all you call uscis again and tell them please send me a anotrher copy of my denied case when you call uscis dont talk first operator because first operator is a uscis contractor tell the first operator i want to talk only immigration officer some time uscis contractor operator dont know about immigration case and they give you wrong imformation about your case and also contractor dont know how to operate immigration case on computer

Call USCIS & cut off the canned speech before the Misinformation contractor really gets rolling. Request to be escalated to an immigration officer. If the contractor objects (probable), say, "You are required to escalate my call to an IO upon my request." That should do it.

Alternatively, schedule an InfoPass appointment for yourself. Good luck, si man.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

hi brucelene i think your denied is only human mistake dont worry wait for 1 week and i think after 1 week uscis only send you request for evidence and your case wiil be fine

hi deb+steve i mean to say brucelene petation is not denied because sometime uscis officer dont know what is doing right hand and right hand dont know what is doing left hand so in that case uscis is only need RFE from petitioner and i think case is fine

I know what you meant and this is true but in this case, I doubt it is fine. It's been nearly 3 years at USCIS. Obviously the OP has issues and needs to have them sorted ASAP.

Thank you for the replies.I post it too here so that everyone can read and :help: if they have ideas and for those also who have the same cases. We will going to post any developments we have in our case.

Well, we'll just wait 1 week as the USCIS Supervisor Costumer Assistance said to wait the denial letter coz we requested a copy.

Please read:

My husband received a letter Dec 17,2009 in response to our Service Request saying that our case was being processed. Early Feb this year, the Senator called my husband and also in emailed dated Feb 2,2010 said our petition is currently with an adjudications officer for review, same as email of the Congressman Feb 1,2010.And we checked our online status its still REQUEST FOR EVIDENCE.

The other day my husband received a letter said it was in response to the inquiry by the Ombudsman and that Pamela Ball, a supervisor of the customer assistance office, said USCIS records showed that our case had been denied last Dec. 18 and they couldn't extend the period for us to appeal

HOW COME WE GOT DENIED DEC 18? WHILE THE SENATOR CALLED AND EMAIELD (FEB 2,2010),CONGRESSMAN (FEB 1,2010) EMAILED, AND THE USCIS COSTUMER ASSISTANCE OPERATOR SAID OUR CASE IS STILL REVEIWED. HOW COME THIS LETTER SAID DENIED DEC 28,2009 and cant make an appeal :unsure: :unsure: AND WE HAVENT GOT A COPY OF THE DENIAL UPTO THIS DAY.

sounds like mucho paperwork and process chaos at USCIS.

Suggest you lookup member 'gogo' here, review his topics, and download his special telephone book for contacts,

and then start contacting the various offices, pushing the concept of 'system failure' on some of the processing steps, internally at USCIS.

Good Luck ! I absolutely loathe to read reports like this, when USCIS personnel make this type of 'mess up'. grrr.

Yes, Darnell,i sent message to gogo and he replied. We did all you advised. and my husband got a letter this morning from uscis stated "the system shows the file is here at the vermont service center. as soon as the file is available, it will be requested and a copy of the denial notice will be sent out to you."

Here's the letter from the USCIS supervisor Costumer Assistance dated April 19,2010: "On behalf of u.s. citizenship and immigration services thank you for your case problem submission worksheet, form dhs-7001 to the dhs cis ombudsman regarding the status of your form i130,uscis records indicate that the California service center denied your form i-130 and form i-129f petitions on dec. 18, 2009. the csc sent you notices explaining the decisions to the address above. please note that uscis is not able to extend the period for you to file an appeal of these decisions.if you have not received the denial notices, you may request a duplicate by calling our national customer service center at ---------- to report non-delivery of the denial notices."

I (benefiary), called uscis. the first person says our case is still adjudicated, and she hold on a minute and asked me if im the petitioner. i told her no im the wife the benifiary. and she told me sorry maam i cant give you the details of the case coz only the petitioner has the right to know it. :unsure::blink: . I told her, channel me to your supervisor, i want to talk to your supervisor. and she told me maam the supervisor will tell you what i told you.so i did told her, i have the right to ask your supervisor, thats what the congressman advised me to do. so she seemed in a hurry to passed it to the supervisor.The supervisor first asked straightly to me if i got the AOS package. :rolleyes: i told her, i called coz i want to know the status of our case, since uscis online status is not accurate in showing the updates. or is not working in the update of the cases.And then she asked me if im the petitioner,and i told her no. and she said tell your husband to call us and we'll give him the info. i told her my husband is working from 6 in the morning till 5 in the afternoon, so he cant call uscis coz its close by the time he arrives home.so to make it short, i dont get any updates of our status. :(<_<

I emailed the Congressman, Senators and Governor Beebe, about our case, and explaining the problem. im still waiting for their reply. and my husband also sent letters to President Obama, Senators, Congressman and Governor as well as Ombudsman and uscis too,together with all the proofs email and phone call from the Senator Feb 1 & 2,2010 and letters from uscis dated Dec 17 and 28,2009,Feb 1,2009 that our case is still reviewed.Husband sent each of them a copies of proof that our case is still reviewed.

Now, i was thinking of filing another I-130. In i-130 question D #2. Have you ever before filed a petition for this or any other alien? Can we answer this with NO. Can we do this? We haven't receive any copy of the Denial letter even though husband requested a copy of it already.

Can you give us again your opinions or ideas on what to do. Please :help: :help: us.

no - must answer 'yes' to file prior petition.

petition is NOT visa. 2 different things.

I am sad - you NOT use gogo's phone book - instead, you contacted him directly.

I know you are driving this, but IMO, yer husband, the USC, needs to drive this.

contacting USCIS help-line is always useful for CASE STATUS, but that is NEVER what I was suggesting to you.

You need to find out why you were denied in order to address the issue BEFORE you file again otherwise you may end up in the same place. If they're being that sticky about not talking to you but talking to your husband, looks like he needs to take a lunch break to sort this out or take a day off work...I am SO sorry this is happening to you! How extremely frustrating! you guys are in my prayers.
