How do we bring his brother to the US from Morocco?

My husband and I are not new to the immigration process, but we are not at all sure about how to go about bringing his little brother of 15 years to the US to live with us. My husband is a permanent resident with his recently acquired two-year green card and I am a USC born and raised.

Custody: Their mother passed away a year ago in June after a lengthy battle with diabetes. Their father had more or less abandoned the family in the summer of 2008. My husband's grandmother has custody of his the little brother and they are both being supported by my husband's older brother.

Situation: The two older boys (my husband included) have discussed that they would like to bring the little brother to the US to live with my husband and I, as they think it would provide him with a better education and overall opportunity. The little brother has been studying English faithfully in hopes that we can arrange for this.

I browsed a little bit on this forum and only seem to find parents bringing children/adoptive children to the US. I am not sure whether anybody knows anything about Moroccan family law, etc. but my first question is whether we would have to 'adopt' his little brother in order to bring him here or whether he is considered 'old enough' to make that sort of decision.

If we do need to adopt the little brother first, does anybody know how we might even begin to go about doing that?

I looked on this website and see that it says you can not bring your sibling to the US unless you have become a USC. I am assuming that I would not be eligible to bring him here because he is not MY brother.

Given the situation, I would hope that there was something we could do without having to go through adoption first... Anyway, if anybody has any information that may help us, we'd appreciate it.

Is it even possible to adopt one's own sibling? (I have my doubts about that; never mind adoption for immigration purposes.)

Yes, you can adopt your own sibling.

Thank you. It appears as though adopting his little brother may appear to USCIS as immigration fraud. I guess our next step is to contact the consulate. Hopefully they could provide us with more information.

Adoption is a lengthy process and there are MANY hoops you'd have to jump through.

Other option is to wait till your husband becomes a USC--which is 3 years from now--and then have him apply for his brother.

From my understanding, that's many, many years.

There's no quick way to do this. As it should be. Otherwise you'd have new immigrants chain migrating their families.

I had figured as much. I don't expect a short process, but I had hoped that there was a process that we could at least BEGIN before my husband obtained citizenship. O well, that's the way it works.

immigration of adopted children usually requires that the relationship be pre-existing. it is allowed if the child has lived with his adopted parents in home country for some years and if the reason for the adoption is legitimate. your case fails on both fronts, in a general sense.
