You might want to study the I-864.

You have to show proof that you make enough money to support the foreign spouse.

USUALLY, a tax return or tax transcript proves up income and income amounts.

The NVC office checks for completeness on the I-864, but the IV Unit at the Consulate/Embassy actually evaluates the dollar amounts listed.

YOU CAN file back taxes immediately - this would be the easiest and fastest way to overcome any further issues.

So I haven't filed my taxes in 2 or 3 years! (major procrastinator :bonk: ) will this be a problem for me to file for the affidavit of support? or worse, cause our application to be denied?

YES!! It causes major issues, go and file them ASAP, the consulate needs to know if you can support your spouse, they do this by looking at your taxes to see how much you declared to the IRS in earnings. No taxes... no affidavit of support.. no visa..

See if you can go to one of those same day places and back file your taxes... :bonk:

You will need to bring your tax filings current to get a visa. If you owe money you must also make a payment plan and expect the money owed to be subtracted from the amount you make in calculating your income. If you have your taxed filed by interview time then your should be OK. If not your inability to follow US tax could land you in trouble as you are dealing with a government agency that it known for a lack of humor and not filing taxes may be a criminal action that would exclude you from being eligible to petition for a visa.

This will not be over quickly. You will not enjoy this.

It was a simply answer. She'll need to file those tax returns. A quick look at the I-864 and instructions makes that quite clear.
