Not difficult, it's impossible to get divorced in the Philippines so annulment is the ONLY option and it can take years!

But wait, there's more...

If a Filipino is married to a foreigner and gets legally divorced in the foreign country the Philippine Gov't will only recognize the divorce if it was filed by the foreign spouse not the Filipino! Then even that recognition requires legal filing which can take a considerable amount of time.

There have been cases where a K-1 Visa was issued to a Filipino who had initiated (and completed) divorce against their foreign spouse but they still couldn't leave the country because the Philippines requires a "CFO" (Commission on Filipinos Overseas) endorsement in their Visa to leave the country but they won't issue said endorsement to a fiancé/fiancée Visa holder who is still legally married in the Philippines...

By the way this is true but I have a friend who filed divorce in Europe but they got married in Phils. They are both PI citizen but her husband works in Europe. When she followed him, suddenly marriage didn't work and they filed for divorce in Europe. And found a USC boyfriend, then the USC filed for k1 it was approved in US then during CFO seminar she was questioned, but for some reason she got away with it. Got a sticker from CFO and now she's in US. lol lucky her. ( I know how she got away with it but can't really tell you how. sorry ).

answer separated coz you are annuled right. so that the philippines embassy knows that you are annuled in your previous marraige. that what i did when i fill-up my papers when i was there in phils.

Actually I am just about to file my visa application for H1B. Currently I am annulled since 2007. Is it okay if I put single? since the legal definition of annulled marriage is marriage that never existed right?

you will answer that SEPARATED that what i did too when i fill-up my papers when i was in the phils. im annuled too. if you have any other question dont hesitate to ask im willing to help..

That's a bit confusing - in the US, "separated" would mean still married but apart. You would not be free and legal to marry if separated (by US difinition of the terms) :blink:

Very unlawful in Phil but legal in US. Ain't that funny? lol In my opinion too, I would put Single coz the application is based in US. Annulment means non consummated of marriage. In US view single and in Phil that's not a problem anymore the OP have her annulment.
