I need help if someone can give me an answer I would really appreciate it. Here is my situation. I live in the US. Next year I am planning to marry my girlfriend that live in Vietnam. But right now her aunt that lives in Canada is filing for her to go to Canada for work. She gets to stay in Canada to work for 2 years if she get the working visa. While she is in Canada will it be easier for me to file for her to come over to the US??? If I can file for her while she is in Canada, how will I do it? Has anyone ever seen a situation like this? I know that if she is in Vietnam I can file k-3 or cr-1 once we get married, but if she is in Canada on working visa, how will I do it???? Thanks to whoever can answer my question.

If she's living in Canada then you would file the CR-1 petition and indicate the Montreal consulate on the form I-130.

That is not a guarantee, USCIS can decide to change the consulate. From what you say, it seems likely that it would be adjudicated in Canada.

MONTREAL. As it is the only one that processes IVs.

Can't remember off the top of my head but it's a tiny box to the right somewhere. Very easy to miss it.

Yes. In all likelihood.

No need to keep posting the same question in multiple forums. :)

Your thread over in the IR1/CR1 Forum is where you will get the best feedback as it is more about the process than Vietnam.

Montreal processes the immigrant visas from Canada, that is why you would put Montreal on the I-130.

Study the example form and the Guide here on VJ. That will help you to be more informed and less stressed.

Please stop posting the same question in multiple forums. Stick here as it is a question about the CR1 visa process.

BTW, consulate is indicated in PartC, Item 22 on the I-130 form. http://www.visajourney.com/examples/INS-Form-I-130.pdf
