My visa was suspended because of my income. I have (CML)cronic myelogenous leukemia and have been in remission for over 5 years now. I am on SSI and its considered government support I.E (welfare) and now need a co-sponser which I am working on. What I am confussed about is the 125% poverty guidlines. I have a couple of friends and family members who are willing to help and their income is above the poverty guidelins but really no assets to speak of. What are the requirements they need for assets?

What do you mean by your visa being suspended?

Are you the beneficiary or the petitioner?

Where are you in the process?

Double check the requirements for co-sponsors at the USEM. I'm fairly certain they have to be close relatives (parents, siblings, etc.)

If they earn 125% above the poverty line for the proposed household size (them, existing dependents, other sponsees, plus your fiance/ee and his/er accompanying children, if any) then you don't need assets. Assets only come into effect if you're using them to make up the income level.

yes we were. we submitted all the paperwork and she had her interview and passed it all but my income because they consider my income as government support I.E (government welfare). I have worked for over 33 years and put into the social security system. The interviewer (Chinese) was very rude and belligerent towards her making statements as to my illiness and her race.

You will need to find a close family memeber (parent, sibling) willing to be a joint sponsor.

Then provide that paperwork to the embassy.

Good luck!

See this FAQ from the State Dept. website for the I-864 for an explanation of assets and their valuation --->> http://travel.state.gov/visa/immigrants/info/info_3183.html#_Assets

The same criteria would be used for the I-134.

My problem is I have no siblings mother, father alive now so it makes it all the harder to do this.

Then you submit what you can. If denied, you either marry and take the CR1 route where joint sponsors are allowed or you give up. Consulates take their responsibilities regarding public charge quite seriously.

Back to this part of your question.

If a sponsor's (or co-sponsor's) income is sufficient to cover the minimum (for their household size plus the foreign beneficiary), they do not need to disclose assets (or not having assets, whichever the case may be).

An additional speed bump might be that USEM doesn't always accept co-sponsors and prefer family members if/when they do (presumably the facts about the entire case/relationship, etc are taken into consideration). In other words - a co-sponsor that might be perfectly acceptable in many countries might not fly in PI.

The link below is to a (kind of long-winded) memo from USEM in regards to co-sponsors.

Yes I know that in the Philippines it is very hard to get a co-sponser approved that is not a family member. My fiance works in HongKong and went to her medical and interview in HongKong. My problem is the only family member I have right now is my step daughter. She is in the Army National Guard and works at a fast food place but made over the 125% minimum and my son is only 16.

Since the interview and decision are being made in Hong Kong instead of Manila, they won't be as sticky on the co-sponsor but that's no guarantee.
