Sachi,

I talked to my friend. The joint sponsor for his case didn't send in a marriage certificate. There was just a letter explaining that the joint sponsor and my friend's mother (the USC petitioner) were good friends and former business partners. I guess NVC either didn't care, didn't catch it, or understood that if you're filing a joint tax return then you're probably related by marriage.

His mom (the USC petitioner) didn't make enough on her own for 2008 because she sold the business early in the year and didn't work after that.

Don't freak out, hon. Whatever it is, it's not going to change just because you're stressing. It's only going to make it harder on you. Go for a run, or have a soak, or make a million dishes of food (my personal choice) to get ease your mind.

Thanks for your responses, guys. Much appreciated.

1) My husband will fill out another I-864 according to the income on his employment letter instead of his 2008 taxes.

2) Will ask joint sponsor for I-864 A. And a copy of his naturalization certificate, just in case.

Bella--If you don't mind my asking--what was your RFE for? So you sent it in without the RFE mail? No problem?

I plan on calling as soon as they open on Monday morning.

Hi there and sorry for the delay. Our RFE was due to the fact that my dependents in 2008 on the tax returns did not match the number of dependents in the I864. Even though I included a divorce decree that would have explained the reason to them, I had to write a letter of explanation as well.

Your RFE could be something as simple as this and not anything you forgot to include.

01-11-10 : Interview scheduled for Feb 4th!!! (doing the happy dance)

02-04-10 : APPROVED...but placed in AP

06-02-10 : STILL WAITING FOR VISA...will this ever be finished and we can finally be together?

07-09-10 : Visa Received!!!

07-17-10 : Arrived in the US safely via Chicago :-)

During one of your attacks, check your I-864 and make sure you didn't count your spouse twice. Did you put a 1 in the spouse square? It's the most common mistake.

To be clear (and so other readers may understand) - the RFE, we now know, was for bank statements. Is it safe to assume that you guys listed a dollar amount in the Assets section (26A for example) but didn't supply any documentation? Or...?

Don't even worry about employment letter and pay subs! They are not initial evidencies and I know for sure that NVC don't need them, they only care for the income evidencies or the co-sponsor I-864 form and evidencies.

Remeber you are required by the Law effective last year to submit only your most recent tax return as an initial evidencies, the other 2 years are just to know that you were employed or not, whatsever.If they are on doubt for anything they will request it after reviewing your/co-sponnsor I-864 form.

May be RFE is becaouse of your co-sponsor W-2 and providing just his anual income. They don't like to see different numbers, they just want everything to match. It is too much for them to figure out and to seperate individual form jointly filed taxes. Just make sure that what it shows on the W-2's or any other proof of income, it shows the same on the I-864 form!

Hey y'all. I have NO idea why they wanted my husband's bank information. He doesn't qualify any way and looks like my joint sponsor's stuff was all in place. Anyway, it's been sent off--now we'll see what happens.

I've thought about it--it could be that a bank statement of our joint account was sent with our initial I-130 petition and maybe they wanted an updated bank statement as that was six months ago? Maybe there was some discrepancy on the form with the actual amount, which isn't much anyway. God knows. But just to be on the safe side, I'd suggest that bank statements are added in the future for all AOS packets.

RFE delivered to NVC at 10:17PM.
