Removing Conditions need your help and opinion on GC expiration

Hello Friends: We mailed Form I-751 on Jan 07, 2010. The only letter we got was for Biometrics, which we took on Feb 12, 2010. However, there was no NOA1 which a few other users have received. My Wife's Green Card and Driver's Licence is expiring on the 28th of February 2010. What should we do? Should we get the passport stamped? Should be call USCIS and ask for a NOA1? Please help us out. Thanks a lot.

You should do both to see which will work faster. I would suggest you look into the DMV of your state and see if they accept the I-551 stamp or the I-797 NOA letter so you could renew the DL. Do that before it expires or else you might have to take the driving test again... once again, depending on the state.

You should have received your NOA1 (which states the PR/Green Card status has been extended by 1-year) by now. This is your proof of legal presence in the US which you'll no doubt want to have on hand.

I would certainly call USCIS (could be an easy task, but I have my doubts about how far that call would take you) or make an infopass appointment. You should definitely follow up on that extension letter (NOA1).

thanks for the quick response. Here is what happened when we went to DMV this morning. They refused to renew the Drivers License as there was no Form I-797-C. So I just set up an infopass appointment for this coming tuesday. I will let you know how that goes. Ironically, there was another couple (also from India) going through the same circumstances. They got their GC extention right away but their biometrics was late, so their GC had expired. But since they had the extension letter they got their License renewed.

BOTTOM LINE: Its better to have a letter giving 1 year extension (I-797C) than having a biometrics appointment letter.

If no I-797C go to infopass and set up a Passport Stamp thing.

infopass will do it. I have one on Thursday. I didn't get my NOA1 either. Don't call USCIS, waste of time. My daughter can give you better answers than USCIS.

BOTTOM LINE: Its better to have a letter giving 1 year extension (I-797C) than having a biometrics appointment letter.

I beg to differ :content: I think the extension letter can easily be replaced with a stamp, while a biometrics letter is crucial for your application as a whole. You see, a biometrics letter provides you with the actual case number (unlike the extension letter) and receiving such letter generally means USCIS have received your I-751 (successfully) which automatically extends your status.

I support all answers above me advising you to get a stamp through infopass.

This could be a difficult task. The ONLY way I was able to talk to a human being was to select the "changing your address" option. lol I had to tell them I haven't moved, I just have a complaint and want my darn NOA. Which hasn't arrived yet. Good luck.
