Time period question. If my fiance comes to America in early March, what are the chances that I can get her AOS by June 31st (about 4 months)

Hi,

I'm trying to see if it's possible that I can change her status in time so that she can qualify for financial aid.

I've heard of people getting the AOS in like 3-4 months. I'm in New Jersey, if that makes a difference.

I guess I would like more commentary on the possibility of my situation, how AOS works, the process.

That's not impossible since some get approved for AOS in three months. What you have to do is get married right away when she arrives and send the AOS application immediately. You better start filling out forms now (write the date later) and gather essential documents (NOA2, DS-3025, etc.).

Still, you can never tell which way the wind blows.

If you mean adding her to your insurance, you don't have to wait for the AOS to be complete.

What do you mean by financial aid? Is this for school?

For many cases, such as adding your wife to your bank account, or adding to your insurance, you won't need to get the AOS done to do that.

And as far as the AOS goes, it's hard to predict how long that would take since everyone's case is different. Most people, however, do get it within 3 to 4 months.

The results of her medical exam are contained in the sealed envelope she will surrender to the immigration officer in the POE. You have nothing to do with that anymore.

You should find a civil surgeon who would transcribe her DS-3025. No need for a new full medical exam. She has to complete the lacking shots and get everything updated in the Form I-693.

By the way...what is this:

H-1B/H-4 Approval Notices from all employers

Is that the same as the K1 visa, where you get a letter from an employer? Or is it another form (H-1/H-4)...

No. This is entirely different. H-1B/H-4 visas are employment based visas where the immigrant is sponsored by an employer. K-1 is a family based visa where the immigrant is sponsored by a fiancee.

You need to go to the AOS forum and read up on the medical info (DS-3025) and the I-693's. Just some friendly advice. Good luck to you.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Difficult but not impossible. Get married and file AOS in the same week she arrives. What type of financial aid? Education? I only ask as some types of financial aid she is not eligible for (at least not without you paying it back) Student financial aid is OK and YES she must be a permanent resident to do this. This is another reason the CR-1 is a good option for a lot of people.

She may be eleigible for financial aid from the school immediately. Alla got a grant from her college and started classes 5 days after arriving (50% grant...but hey, why not?) Use the time to get her foreign credentials certified and for her to pass the TOEFL exam. Required by many colleges.
