(the story)

From across the night I was dazzled by the the sweetest looking thai girl while in Phuket Thailand. After I sweet talked her and was able to score a date One led to another, and she quickly left her horrible job to come live with me at the muay thai camp I was training at. We later left to her home in north east Thailand for me to meet her parents and the local community. Her family liked me, and approved of me staying at there home with there daughter. (Not drinking or smoking appears to go a long way with a thai family) From the start it has been about two weeks now. We are madly in love with each other, and want to give the chance of a future a shot. So my first thoughts were to take her back home to America for about six months, see how the relationship does, not let her miss home too much go back to thailand and come home and live happily ever after right.

Wrong after looking into this process it appears to be much more complicated than that. After considering a tourist Visa, a student visa, a working Visa and a Fiance visa, it seems a fiance visa is the best option. This means that for two kids (yes at 26 I still consider myself a kid) we are going to have get married within 90 days of her comming into the country, talk about pressure. The final suprise was about ten minutes ago when i found out that after she recieves a visa she can not leave. This is a girl that gets home sick in about a week. So as i find that my tax dollars are hard at work when i visit the Embassy in bangkok and discover it is impossible to talk to a real person about all of this.

(the question)

So I'm at the start of this yellow brick road. I'm looking for any advice on where I start, how to fill out all these forms, and what should I expect on the way. If anyone can give me an Idea of how complicated or how much time is involved in all this paper work I would appreacieate it. I'm seriously considering paying the $1800 at this point. Any advice would be much appreciated. I kida feel like a rat in a cage at this point running in circles.

Start with the guides, go from there.

In my humble opinion, you might want to work on building the relationship longer before jumping in the deep end. It doesn't sound as though it would be an easy move for her and you're right, it would take 60-90 AFTER getting married and filing her Adjustment before she could travel (or work) using her AP (or EAD).

Communicate via instant messenger and webcam, write letters, get to know each other better and plan another trip out there in a couple months. Take your time getting to know each other. It can only help you along every step of both your visa and your life journey as a couple.

I agree. I'd really extend this relationship beyond two weeks before committing yourselves to each other for the rest of your lives. Many people on here have done the long-distance relationship thing for a couple of years. Better safe than sorry.

To be honest she was a prostitute. Many will judge few will understand

It's not about those who will judge or who will understand--the law says it disqualifies her from getting a visa or immigrating.

But given her former job, I think you'll be hard pressed to get a visa for her anyway.

(the story)

we are going to have get married within 90 days of her comming into the country, talk about pressure. The final suprise

If getting married within 90 days of her entry to the US is a big surprise and a lot of pressure for you two, then you are not ready to begin filing for the K-1. The K-1 is not a get to know you visa; you two are supposed to have already made that committment, the committment to marry each other BEFORE you file the visa petition. Think very clearly here; don't jump into a relationship that you two have second thoughts about.

was about ten minutes ago when i found out that after she recieves a visa she can not leave.

Again, you are supposed to be getting married......forever......meaning always together.......like in the movies........sounds like your relationship is not solid enough for this. If she is so madly in love with you and WANTS to live together as husband and wife, then there will be no big problem. Getting homesick is OK, but if she really wants to be with you, then she will overcome that.

This is a girl that gets home sick in about a week. So as i find that my tax dollars are hard at work when i visit the Embassy in bangkok and discover it is impossible to talk to a real person about all of this.

What would you want the Embassy to tell you?

(the question)

So I'm at the start of this yellow brick road. I'm looking for any advice on where I start,

Read the Guides, follow the guides and Example Forms.

how to fill out all these forms,

I used a pen and used the English language.

and what should I expect on the way. If anyone can give me an Idea of how complicated or how much time is involved in all this paper work I would appreacieate it. I'm seriously considering paying the $1800 at this point. Any advice would be much appreciated. I kida feel like a rat in a cage at this point running in circles.

Sounds like you yourself need to do more homework before you post any more questions. The process is very simple.

Sorry. US immigration law specifically excludes her from getting any sort of visa to the US if she has engaged in prostitution within 10 years prior to submitting her visa application. You can try to get a waiver for this inadmissibility under section 212(h)(1). I recommend you speak with a qualified immigration lawyer if you want to pursue this.

I sincerely hope your full name is not Matthew Land. The USCIS is reported to read these forums...

And it's not about judgement or understanding. It's about the law. Sadly for you both, it states that any form of prostitution renders a beneficiary inadmissible, depending on the circumstances of their work history.

Do not underestimate the Embassy's knowledge and understanding of the cultural norms. You cannot lie on your petition about her employment history, so you cannot avoid this obstacle. And it's not a hurdle, it's a big effing mountain.

I'm sorry to say, but it really sounds as though this is a relationship you need to chalk up to one of those life experiences that you'll always be able to carry with you, but was a case of wrong time and place.

At the US Embassy, they will require accounting of her time since she left school. They definitely will require letters from all employers for a history of employment.

If you met in person in Phuket, that will be a red flag.

If you have met online, flown to Bangkok, met her there and then flew to Phuket for a one week holiday, that would be more reasonable.

I think it will be very difficult.

i don't have any advice to offer but i wish you luck.

audy rob, is that a new requirement on employment letters in bangkok? when my husband went through there (nearly 3 years ago) it was not required. i would think for a good number of thai's that it would be difficult since there are so many cash type jobs in thailand.

As far as I'm aware, she will not be eligible for a visa based on the fact she was a prostitute. She may be able to get a waiver, but it will be a long and hard road for you.

Have you considered moving to her? This may be your best option.
