At the moment im collecting paperwork for AOS from K1..... at the moment my husband and i have no plans to leave the country before my green card arrives, he cant get any more time off work for a while and we cant afford it (thanks to the AOS fees!!) so i wasnt planning on sending in the form I-131 application for travel with my AOS package. my question is whether people would recommend sending it in anyway, or is it just one more unnecessary form to fill out??!

The I-131 is not really difficult. It has no filing fee anyway if you send it with your AOS. It might be helpful if the foreign spouse has to go to his/her country for emergency purposes.

I can't see any harm in completing it and sending it in. It is included in the fee (as you know) and you never know if you might have to have it (things come up). We didn't (at that time it was a separate fee) but we would today if we had to.

Incorrect - it is not included in the cost of the AOS (which is just the I-485 + biometrics).

It is "free" if filed with the AOS or after the AOS was filed (but not completed with USCIS).

I post this to prevent people from thinking they can remove the "cost" of the AP/EAD from the $1010.00 if they don't send them at all with the AOS.

(yes, I was asked that question, several times....)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

How about questions 3 and 4 then where it asks for a departure date and reasons for departure? what should my answer be if I dont know when i might use the document?

I would put "Unknown at this time."

Has anyone had any issues with the accompanying "statement" the form requires, explaining why you require to travel? is it sufficient to say that the purpose for travel is unknown at this time and that it would be used for emergency purposes?

We put something to the effect of "TBD - In case of emergency requiring international travel"

I haven't read anything about people having problems with this form/document, they pretty much rubber stamp them - even if you aren't eligible to use it! (Due to overstay ban, etc)

K-1:

January 28, 2009: NOA1

June 4, 2009: Interview - APPROVED!!!

October 11, 2009: Wedding

AOS:

December 23, 2009: NOA1!

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

March 15, 2010: AOS interview - RFE for I-693 vaccination supplement - CS signed part 6!

March 27, 2010: Green Card recieved

ROC:

March 1, 2012: Mailed ROC package

March 7, 2012: Tracking says "notice left"...after a phone call to post office.
