Timeline

My husband entered the USA as a K-1 Visa holder. When we filed the AOS, we also filed the I-765 EAD. Now that I am filing for the renewal I-765, I have a few questions.

1. Since it is a renewal I-765, I assume we still need to pay the $340.00 filing fee.

2. Where it asks what office we filed for his first EAD, I assume the answer is the Chicago Lockbox???

3. What do I put under his Current Immigration Status? Is that Conditional Permanent Resident?

4. Question 16 - Eligibility Categories...is that different now that he's a conditional resident?

Timeline

If your husband has his green card no EAD is needed. The GC authorizes him to work.

Why are you renewing the card? If he has the greencard then THAT'S his work authorisation and he doesn't need the EAD...

Directly from the USCIS website. The information that has been provided is from the questions you have asked. By using any of my suggestions or advice you surrender all legal actions that can be placed upon me in the court of law. The information I am providing is simply found on the USCIS website and should only be used with the knowledge that it could be wrong.

1. If you are filing for an extension of your Employment Authorization and your Form I-485, Application for Permanent Residence, was filed before July 30, 2007, then you must pay the $340 filing fee.

2. ?

3. Hes only a conditional permnant resident if he has a 2 year green card in his posession. Therefore, he would not need a EAD document.

4. If your filing this based on his I-485 still pending, then you would put ( c ) (9) for his elegibility category.

Otherwise if he does have a conditional permnant resident card, go ahead and throw the application out. He doesn't need the EAD card.
