I was wondering if anyone could advise me .. my fiance(us citizen, I'm a British citizen) had alot of trouble obtaining his US passport, even though he was born to us parents, lived all his life in the US and is in the us airforce because the name on his birth certificate is wrong. When he was born they registered him with a double barreled last name (very complicated story - they used his mother last and her ex husbands last name!!) He finally managed to get his passport last year (even though he'd been in the US airforce by then for 5 years!) but now we are applying for a K visa and i'm worried it will complicate the situation as his birth certificate shows Jamal Washington-Smith and his passport is just Jamal Washington. Does anyone know if this will delay the process or what we can do so that it wont? Hope this makes sense!

You know I don't think it would matter since he is the US citizen... I think it would be more of a problem if it was you.

SOmeone I'm sure can help you more though.

I'm sure he can just explain the names somewhere along the way, and try to get his passport changed.

thanks :) the trouble is that he doesnt want to take the name on his birth certificate as its not even his name!! lol! (well the last bit anyway!)

As he is the USC, all that is required from him is to submit either a birth certificate OR passport along with the I-129F to show that he is a USC and eligible to be petitioning for a fiance. Check the guides at the top of the page for the K-1.

Washington being the name he uses and is known by would be his 'family name'. Washington-Smith would then be listed in other names used.

If the USC uses his passport in lieu of birth certificate, the USC needs to provide copies of every page of the passport, right?

I have two last names (as do most latinos) and my social security only has one last name while my naturalization certificate has both. My passport only has one. I've never had any problems before (knock on wood)

hello Tamzyn base on my experience we need to follow what it says there in our birth certificate even we didnt used it just like my sister's name sinse shes studying elementary grade until she graduated in college shes using lolita and then she found out her name in birth ceritficate is not lolita but LULU so she start using her name in the BC and she dont have any problem about it bcoz she used taht also in her passport........but its just what i have experience....

Thanks for the info - i have one question though - why should he have to use a name that has nothing to do with him as the second part of the double barrelled last name is his mothers ex husbands name, not even his dads name? it doesnt make sence :wacko:

Family name is the name one is known as. Also eg a womans name when married is not always the one on her BC. You have documentation with your passport using Washington only. Submit all pages of your passport with the petition to show that you are a USC...this is one of the two options to prove that you are a USC.
