Hi Everyone,

I know someone who just submitted an I-130 and he stated that he was just starting the K3 process to get his wife over. Now I'm very familiar with the K1 process, but I told him I heard a lot of people on VJ prefer the CR1 over the K3 due to the lower cost (without AOS) and relatively equal amount of times of processing.

From what I read in the guides, it seems it is possible for him to still choose a CR1 path over K3. He has just submitted the I-130, but has yet to receive NOA1 for that. Am I correct to assume he can still take the CR1 path at this point? or is he stuck taking the K3 path?

Can you think of any negatives for him to take a CR1 over a K3?

He can still go CR1. If he does he doesn't need to file the I-129F.

With only the I-130 filed, they are already on the CR1 path. To remain that way, simply refrain from filing an I-129F for spouse. It will move the I-130 out of its place in line.

Thanks for the info! I'll let him know that. I told him unless there is some big advantage going with a K3 through his embassy in Singapore, it probably would be better to just go with a CR-1.

Can anybody expand a little on this — bold text specifically — for me?

I'm familiar with the process overall, but this part stood out for me as pertaining to our own case. We have NOA1s for each, however the I-129f was received and receipt dated almost a month after the I-130.

Any ideas on if we'll face problems with this? We'd prefer the I-130 of course.

By submitting I129F you are on the K3 path and you dropped CR1 and lost your i130 line.

Generally you can later restart CR1 but after going through the K3 line up to NOA2 and if Service center gives NOA2 at the same time for K3 and I130 (2 simultaneous NOA2s) . You do so by dropping K3 at embassy level. (i did it) Except sometimes only the K3 NOA2 comes out (no luck). When restarting CR1 it will be at NVC level that is what is fast for K3s but less fast for CR1.

01-30 received tracking number for GC Welcome issued on 01-27

but not yet SSN

SSN expected by Feb 20 else I might go and ask for one regardless of DS230

GC expected by March 27

Feb 3 2010 update card ordered says to allow for 30 days

Feb 8 2010 update saying approval notice sent

Feb 12 2010 received GC card Permanent resident valid till 2020

Feb 18 2010 went to file ss5 for ssn card as not yet received and center would not find me in ssn files

... What happens is you file the I-130 first, then you receive your NOA1, then you file the I-129 for the K3... Your CR1 application is pulled out of the line and held up until they adjucate the I-129 and you suually receive a NOA2 for BOTH applications... From there BOTH applications are sent to NVC and the CR1 stays there and the K3 is forwarded directly to the embassy BOTH APPLICATION ARE PROCESSING it is not a case of the CR1 is dropeed fromprocessing, you just lost your earlier place in line.... From that point you will receive communications from NVC to submit documents to them AND in some cases communication from the embassy which is processing the K3... If you want to keep with the CR1 (much advised) then you ignore the communication from the embassy regarding the K3...

I would correct that it is true in general

there are some exceptions I have seen where only the K3 received NOA2 while I130 never received it.

technically it has to be at the same time, else I130 dies when K3 receives NOA2

did you see latest rule dated Feb 1st 2010?

so if both i130 and i129f approved together (NOA2) K3 dies

(if I129F only approved CR1/IR1 continues dying)

practically will depend on noa2

but if uscis continues approrving both at the same time in general

K3 is virtually dead

while I must say it had some advantages
