HI GOOD DAY! I'M BEVERLY FROM THE PHILIPPINES.I WAS TRYING TO GET THROUGH HERE TO VJ FINALLY, CAUSE I HAVE A PROBLEM REGARDING OF MY VISA WAS EXPIRED SINCE LAST AUGUST 28,2008.TOGETHER WITH MY FILIPINO SON WHICH IS MY DERIVATIVE.AND I HAVE ALREADY 2 KIDS WHICH WERE BOTH AMERICAN CITIZEN.NOW I AM CONFUSED WHAT TO DO WITH MY EXPIRED VISA. I WOULD LIKE TO ASK SOME HELPFUL STEP ON HOW TO GET A NEW ONE? DO WE HAVE TO START ALL OVER AGAIN FROM THE BEGINNING? OR JUST RENEW IT AT MANILA EMBASSY WITHOUT ANY TOO MUCH REQUIREMENTS TO DO? I AM LOOKING FORWARD TO HEAR FROM U GUYS SOON.THANK YOU VERY MUCH..AND MORE POWER!

If your visa is unused and has expired you will have to start a new petition.

If you are in the US and your conditional greencard has expired..... that's a different story.

If you are in the US and did not adjust status you will need to do so as soon as possible.

Can you tell us which one it is?

I think she is still in the PI, since she mentions trying to renew it at the embassy in Manila.

So it appears they will be doing the petition/application again.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

You said your visa has expired, if this is the case and you did not use it and are still in the Philippines then yes, you will need to re-file. That means all the paperwork, the fees and everything again.

If you are in the US having used the visa and you haven't adjusted status yet, that's a different matter.

If you are in he US and your greencard has expired, again that's a different matter.

We'll need more info but based simply on your first post it looks like you just never used your visa which means re-applying. It won't go any faster either. You will need to re-do your medical if it's expired (it only lasts a year) same with police checks etc.
