To answer your questions. Yes you can file a petition. Will a visa be denied....that is up to the consulate officer conducting the interview.

If you are a U.S. citizen, you may apply for the I-129F to bring your fiancé over just like any other citizen. And just like any other citizen, you'll have to prove that you've met in the last two years, that you intend to marry, and that you have an on-going relationship.

The consulate has final authority, and it is possible that they will look closer if the marriage looks fraudulent. But it's hard to judge what a consulate will find worrisome; if you're really concerned, talk to a lawyer.

(If you're a troll, you should probably know that the 'me foreigner me no speaky good english' thing is a pretty lame parody. If you're not, no offense intended.)

There are many reasons that an application for a visa can be denied. Have a read of the guides in the tab at the top of the page....In short, submit your petition with any supporting documentation as described...once approved it will be forwarded to NVC, assigned a case number then forwarded to the consulate. They will also conduct security/name checks at the various stages. For the consulate you submit the necessary paperwork and documentation (there is much available on this site that is relevant to Mexico) and then it is up to an adjudicator. If one is eligible for a visa, one will be granted.

Why don't you first realize that "legitimate" petitioning for a visa, is not discrimination against anyone from anywhere. It is all about the individuals involved. That would be you....

Adjudication happens somewhere else, not on this board.

And to everyone who has resorted to responding with name calling, I suggest you follow the 'rise above it' example that Aussie has set many a time, esp if you are rising to her defense. Name calling and personal attacks are completely unnecessary. If you have a beef with a poster, take it offline or ignore them.

To the OP. You have the right to file now that you are a citizen. The circumstances will raise red flags at the consulate. Good luck overcoming them.

Not much you can do. Document your relationship. Have a good reason for the change in partners (former hubby to former boyfriend) and just hope for the best. A good lawyer wouldn't hurt either.
