Are immigration officers required to take away the greencard when you are given the temporary one year stamp in your passport. I went to an infopass appointment and the immigration officer took away my greencard. If anyone had this issue can you let me know if this is normal.

If you had a greencard then why did you need the I-551 stamp?

I don't know if 'it's required', but I smell a regulation, somewhere.

FOR NOW, you're ok - you got the work authorization inside of your passport, as well as another I-551 stamp.

I sent in ROC at the end of November. And I never received my NOA1. My greencard expires in 2 weeks.

I've heard of it happening, when the ROC case is taking too long, and the 2 year card has expired.

Some USCIS offices do take the expired or soon to expire green card and some don't. I didn't receive an NOA either and got the I-551 stamp in my passport. My green card was returned to me. Others who also didn't receive their NOAs and got the stamp did have their green cards taken. If it is a regulation, it is not applied across the board and seems to vary from office to office. Regardless, the stamp in your passport takes the place of your green card. The down side of this is that you now need to carry your passport with you as proof of your legal status in the US. Be sure to make several good copies of your passport and the I-551 stamp. Hopefully, your ROC will be approved quickly and you will receive your 10 year green card. My application, unfortunately, took 12 months so I had to carry my passport with me all that time - which was a concern to me. Good luck.

Thanks Kathryn1. I just wanted to know if he IO really knew what she was doing! LOL She did seem a bit scatter brained. That is why I needed some reassurance. I will make the copies of the passport as suggested. Thanks again.

If one more account eases your mind further, my husband made an infopass and asked for and received the I-551 stamp after he applied to remove conditions (he needed the stamp with one-year extension to register for classes and didn't have time to wait for the NOA). When they gave him the stamp, they took his green card. This was in Charleston, SC. He had to carry his passport until he received his 10-year GC.

I'm the USC.

11/05/2007........Conditional permanent residency effective date.

01/10/2008........Two-year green card in hand.

08/08/2009........Our son was born <3

08/08/2009........Filed for removal of conditions.

12/16/2009........ROC was approved.

11/05/2010........Eligible for Naturalization.

03/01/2011........Separated.

11/05/2012........Eligible for Naturalization.

I guess it's quite normal. At least when I went to an infopass to get an I-551 stamp, my expired greencard was taken away.

Thanks everyone. I was a bit worried at first. Given that I will be registering for classes soon too travelling a bit before my 10 year greencard.
