hey all! im brand new to this whole thing and before i start the grueling paper process i would like to get some questions answered.My fiance lives in england and i live in the US.He is the one moving here so that leaves me being the one to do all the paperwork.So we want to get married then apply for the spousal visa.My question is after we are married does my husband have to go back to england then i apply for the visa or is he allowed to live here while we file for it?Also I work full time so how much a yr is good enough to make in order for them to approve that i am financially stable enough to support my husband?I still live at home but if i make enough money to prove i can support him do i still have to have a co sponser such as my parents?Im sorry if these questions have already been asked previously but I need all the help i can get because reading all of this info is overwhelming lol.Any advice u can give me is also appreciated too.Thanks!

Lol. Actually he's the one with a MOUNTAIN of paperwork ahead of him. He needs to do a medical test, get a police check, go to an interview, supply his birth cert (you too), divorce decrees (you too if applicable) and that's just the beginning. You need to do the finance stuff but my husband (then fiance) always felt bad that he just sat back (except a little here and there) while I did everything.

Usually the visa stuff is done in the country of the beneficiary. Here's a good page for comparisons: http://www.visajourney.com/forums/index.ph...mp;page=compare it looks like the K3 allows him to live in the country but it takes 12 months (like the K1) to be a legal permanent resident. Also if you look at the cost comparisons the IR1/CR1 is MUCH cheaper and also quicker but he would have to stay where he is for the duration. The bonus is he's able to work as soon as he enters so personally had I known this I would have done it. Remained working till I left Australia, then commenced working when I arrived here. The K3 requires adjustment of status so he would need an EAD (employment authorisation document) and they take up to 90 days. Being apart sucks but the monetary stress (and boredom) of being stuck here unable to work is a little tedious.

I don't believe where you live matters as long as you're able to support him. You need to be 125% above the poverty line. Here's the form that lists the amounts needed: http://www.uscis.gov/files/form/I-864P.pdf as long as you're above that then it's all well and good.

Yes, I agree - the Cr-1 is the superior visa. You do have to be married to apply and then your husband will need to return to England for the duration of this process. He cannot live with you until he has his spousal visa.
