Did you call or go into your local DMV and ask? or check the DMV website for instructions for your state on how to get a state ID. Every state is different and for specific information you should call them or go in and check.

Yes i tried to call them several times but the line is so busy that i can't get through. That's why i posted here first hoping to get a good advice with VJ members, but i will try my luck calling them again. Thanks

It's hard to tell without knowing your state. This is a state owned issue, so it can vary depending on where you live in the US.

Once you have that, then just google <your state> drivers license requirements. Look for the government webpage (probably ends in .gov) and navigate from there. I'm sure there will be a listing of the requirements for obtaining a state ID card or drivers' license.

It says AOS applicants can get a 1 yr card (in the table, page 5). So by showing passport, K1 visa, and NOA1 for AOS application, an ID should be obtainable.

I recommend printing the table and taking all the above to apply for the ID.

this link said you must have 6 months minimum left on your visa...then you can get a temp ID or DL. I have been there personally.

The table said... you must have an EAD or in the process of AOS. Bottom line, you can not get an ID/DL right away with just a passport and a K1 visa. You either have to have an EAD or in AOS status

Can i apply for an state ID without SSN#?

i'd say NOPE! u cant...DVM in our state asked for my SSN and GC...but you can try...

It seems a conflict that the table says K-1's can get a DL/ID, but they still list the 6 month requirement even above the table. An AOS applicant would be allowed to stay until their application was either approved or denied, thus would fall into the open ended category. Perhaps that would suffice in getting a DL/ID. Would be interesting to send a well-crafted letter to them and get a response on both the K1 discrepancy in the table and the AOS applicant status:

I would most definitely try taking the table you provided to see what happened at the Texas DPS if I was a new K1. That table has a 2009 date so it's not an old document still on the web. The law changed requiring the 6 months status on Oct. 1, 2008. Actually is wasn't even a law change (by the state legislature) but rather a policy change. That change date happened to be Nick's first day in the US. Darn! Had he made his flight arrangements earlier, he could have had a 6 year DL. In Nov/Dec of 2008, I wrote a number of letters to officials at the headquarters in Austin including the person whose name I found in memos regarding the new law. I explained how it precluded a K1 category person who was only granted 90 days so would never meet the 6 month requirement, even though they were indeed legal to remain in the US while awaiting AOS. K1s are in such a limbo category and don't fit the much more common immigration status.

Texas law says you have 30 days to obtain a license after moving to Texas, but a K1 who has move here can't get a license within 30 days. We had an incident where Nick was stopped for speeding by a state highway patrol trooper. He looked at the UK license and said "are you visiting?" Nick said "No, I've lived here since October." Well then at 10 pm at night on the side of the highway, we get this lecture on how he had 30 days to get a license. I explained he had been to the DPS office twice and couldn't get a license and I had found that a visitor can drive on their foreign license for 1 year. He wasn't buying any of it, but I explained the K1 limbo well enough that he believed us and let us go without hauling Nick in as an illegal. And he scratched off the "no driver's license" off the ticket and said he was going in to the driver's license office himself to find out if what I said was true. The good thing that came out of it was, the ticket isn't on his driving record because he didn't have a TX DL when he got the citation.

Anyway, that table gives me hope that somebody listened to my letters and at least the K1 category is addressed in it. The only problem with the table is it says the license will only be good for the length of the I-94. That's not a lot of time...90 days and reduce that by the time it takes to get your SS card, get married and get the marriage certificate back. You pay for that license, then you go back and pay again for a year's license by showing the EAD, then you go back and show the GC and PAY again to get the normal, non-temporary Texas DL. It's rather a lot of money and hours standing in line at the DPS. But I would still challenge it just for the heck of it. I'm currently in correspondence with the Texas DPS over non-USCs having to go in person (2-3 hrs) to change their address on the DL, rather than being able to do it online.
