New York toughens drunken driving law

Why set the limit at under the age of 15. This I don't understand. The limit should be passenger under the age of 18. Well we all know why..... All these lawmakers children would be in jail their senior year in highschool. What is a "drug" that can have you arrested with a felony . I guess we can build more prisons and will have more employment in Child Protective Services.

Under the law, first-time offenders with a blood alcohol content of .08 or more or under the influence of drugs, and with a child age 15 or under in the vehicle, will automatically have their drivers license suspended, will have to install a ignition interlock device in their car and may be charged with a Class E felony punishable up to four years in prison.

In addition to the increased sanctions, parents caught driving impaired with their children will be reported to the Statewide Central Register of Child Abuse and Maltreatment.

Wisconsin just made the forth rather than the fifth conviction for drunker driving a felony, big deal with a similar provision if they find kids under 16 years of age. We have a very strong tavern owners lobby. Still can't buy a bottle of wine after 9:00 PM or a six pack of beer at any liquor or now grocery store, even Wal-Mart, but can hit zillions of bars until 2:00 AM with absolutely no way to get there except by private vehicle.

You can drink until you have completely blown your brain, but you cannot smoke, the latter is considered highly dangerous.

prison? the US and its bandwagon on prison time is getting truly ridiculous. for stupid offenses like this, a heavy dose of community service would do and it would serve the community in a much better way.

i'm thinking, however that the libs should fund a program for drunks to be picked up at the bar for free after a night of drinking. taxis are outrageous and bars need the business. man oh man though, a beer is 6 dollars here in CA... that is outrageous too!

almost nothing pisses me off more than when a hollywood type or the rich professional sports type get caught DUI. most people don't call a taxi, because of the expense, but these folks have the bucks so the book should be thrown at these types more so than anyone else.

I used an online calculator to see how many drinks it takes to get to .08.....4 Whiskey Sours, if you weigh about 180 and you drank them all within an hour. Now I weigh more than that and I know that if I drank for 4 Whiskey Sours within an hour, I'd be having a hard time walking in a straight line to the restroom.

Listened to plenty of criticism to this similar law in Wisconsin, who is going to pay for it for one. Assembly refused to include a liquor and beer tax to help pay for it. And what's this about a younger than 16 year old kid, what about your 70 year old grandma in the back seat. Didn't say anything about your mother-in-law, but maybe that is because she drove you to drink.

Yeah, we have a couple of taxis in town, but zillions of bars on every back road in this state, you won't find any cabs around there, cops, yes, hidden behind the trees. One thing you don't want to do, is to drive on these back roads after 2:00 AM in the morning.

But since we hold the record for being the drunkest state in the union, our assembly had to do something, even though all the critics say, it won't change a thing and will only cost the taxpayers more money.

You must be one of those MADD ladies, met some here. Let me put it this way, they have no sense of humor on this subject and perhaps, rightfully so.

Another thing they mention is some kind of interlock will have to be installed on the culprits' vehicle, haven't seen one, but gather they have to breathe into it before their vehicle will start. What if they have more than one vehicle or can borrow a friends vehicle? And would air bellows work just as well? What about the bartender serving these drinks? No problem for him, he is a member of a very strong lobby.

The trouble with this law as with all laws is if you have enough pull you get off. If you don't have commections you go to jail. Pick up any paper and some people just slide out of doing any time. Most people at some point in time have been behind the wheel when they have too much to drink. I have a member of my family that was 18 and killed a girl after drinking. Ruined her life, her parents life,He is doing 10 years,you might say ruined his life. As with all parents if they can afford it they hired a good lawyer. They paid $50,000 on just a retainer. I have no idea what they actually spent. Mother worked for a church and the church let her go. Parents took out a second mortage and due to the economy and mother not working they will loose their home. It is just a big mess. and it will go on for decades. He will never drive again according to the plea deal. What employment will he get when he is let out. You talk about screwing a lot of people's lives up
