Should be safe, I've seen posts here where others have used the form thats expired with no problems over the last month.

that is the OMB expiration and is not necessarily the form expiration...

Note on Expiration Date:

Please note that USCIS is currently accepting the 08/25/2008 version of Form I-751. The Office of Management and Budget (OMB) is still reviewing our request for an extension of this form. We will post the form with the new expiration date once OMB approves it.
