yay! we're eligible for the waiver! :)

my fiance got in line at 8am and was done at 3pm.

they asked him questions about how often he talks to me, the names of my parents, and about him crossing illegal...and the lady didn't believe him about him just walking across the border. she said she lives on the border and nobody can ever just walk across with no questions...but he did! lol...

anyway, we will call after going back to my fiances parents and make the waiver appointment :) woooohoooooo!

one question though:

they didn't keep my I-134 form, but they kept copies of my taxes and letter from my bank. why?? i did have three additional sponsors and they took all of that information...should i worry about them not having my I-134 form??

wow...

Honestly, you wont find too many happy people to see you eligible for a waiver when your SO came illegally. Especially when 95% of us took the time to go through immigration the correct and legal way.

True, but setting that aside for a moment: Congratulations, si man! :)

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

She IS doing it the legal way, he is LEGALLY eligible for a waiver.

Good luck with the waiver.

thank you emt103c and TboneTX :)

and yes we ARE doing things the correct and legal way.

Sinergy, you should not pass judgement for a situation that you do not know all of the facts on, nor were you in their 'shoes'. When it comes to family and people you love, you will do what it takes to survive. Until you have known that feeling, please do not feel you are better than another just because you've been handed a better route. I do not condone illegal behavior and actions..I AM a very good person and so is my fiance, so I don't appreciate you being judgemental toward us. Thanks. Also, I AM A U.S. CITIZEN, so I do not deserve your bitterness. Do you know anything about Mexico? Have you ever been/resided there? By reading a few things on your profile, I can see that you feel you and yours are better than most... I sure hope you don't treat everyone that way. It's not nice.

I will add an official warning reinforcing Malrothien's and Chica Yeye's comments: judgmental comments that 'might' be permitted in the Off Topic Forum are not allowed in the Immigration Forums. Further off topic behavior will be met with administrative action. If you have nothing useful to add to the forum, then please do not post at all.

“...Isn't it splendid to think of all the things there are to find out about? It just makes me feel glad to be alive--it's such an interesting world. It wouldn't be half so interesting if we knew all about everything, would it? There'd be no scope for imagination then, would there?”

Congrats on being eligible for filing a waiver! I'm on the same journey as you, my fiance needing to file a waiver. Unfortunately many people on this site have no compassion and are uneducated in the immigration arena. Join me and others in the same situation on www.Immigrate2us.net. You'll find much more information regarding waivers.

For those who think illegal is illegal don't judge someone else until you've walked a mile in their shoes.

yes we went through ciudad juarez..no there was no pre-approval. i'm not aware of any pre-approvals in mexico...but ciudad juarez is supposed to be the ONLY consulate that issues visas in mexico.

and thank you :) i will try to ignore the ignorance and negativity given..it's only from a few individuals on this site though :) don't get me wrong, there are many friendly and helpful people here too, and they are appreciated.
