First of all, you could apply for a same-day or next-day passport at any of the 14 regional passport agencies across the country.

I applied for mine yesterday and picked it up today (I travel on Friday).

However, if you can't do that, you can leave the US with your old passport (even if they ask for a green card, it's the airline employees, not CBP agents) and apply for a US passport at a US Consulate abroad.

I actually inquired with the US Consulate in Milan about that. They do that bu since all US passport are now printed in the US, it takes up to 2-3 weeks. So if your stay will be long enough, you could do that, otherwise you're going to have to find a way here in the US before you leave.

Of course, I assume that your country of origin allows dual citizenship and therefore your previous passport is still valid....

If that's not the case, then you must get a US passport before you leave.

Send an email to the US Consulate on your place of stay and see what they say.

I did that because there was a chance of me taking the oath the same day I had to leave but luckily I got the oath a week earlier.

But you can go to a regional passport agency and get a same-day passport for the same price as expedited service at the post office.

Anyways, if you apply for a US passport abroad, don't forget to bring your certificate of naturalization with you.

In order to comply with INA 215(b) you've got to get a US Passport before leaving. You are now a US Citizen who has not yet obtained his first US passport. Like any other US Citizen without a US passport, you're supposed to get a US passport before travelling internationally. The fact that you also hold a valid foreign passport doesn't matter when you cross the US border (you may use another passport at another country's borders, though).

INA 215(b): Except as otherwise provided by the President and subject to such limitations and exceptions as the President may authorize and prescribe, it shall be unlawful for any citizen of the United States to depart from or enter, or attempt to depart from or enter, the United States unless he bears a valid United States passport.

But nobody ever checks or stamps a US (or any other) passport on the way out anyways so there's no way to enforce it.

As long as you don't apply for a US passport from foreign soil, you may be right.

If you apply for a US passport while abroad, they'll ask you whether you lost your old one, so that they can inactivate it. They'll search passport records and find you've never been issued a US passport. At that point, they'll know you violated the law, since you're present outside the US, and they know you were naturalized inside the US.

If you don't apply for a US passport while abroad, you'll have to re-enter the US with a foreign passport and no green card. Good luck with that, and good luck not getting caught in a misreprentation problem. US citizens are supposed to identify themselves as US citizens at US borders.

How seriously do they take such violations? I don't know. I'm not going to find out.

LucyRich,

Thank you for the posting. That was highly educational and superbly written, as usual.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . The one absolutely certain way of bringing this nation to ruin, of preventing all possibility of its continuing to be a nation at all, would be to permit it to become a tangle of squabbling nationalities, an intricate knot of German-Americans, Irish-Americans, English-Americans, French-Americans, Scandinavian-Americans or Italian-Americans, each preserving its separate nationality, each at heart feeling more sympathy with Europeans of that nationality, than with the other citizens of the American Republic . . . . There is no such thing as a hyphenated American who is a good American. The only man who is a good American is the man who is an American and nothing else.

I think you're being a lil paranoid.

I did my research last week.

This is my email to the US Consulate in Milan:

"To whom it may concern:

I’m an Italian citizen and green card holder living in NYC.

I have my Naturalization interview next week and there is a chance I might get naturalized right before my wife and I are scheduled to go to vacation in Egypt and Italy.

I know US citizens must enter the US using a US passport and I intend to do so once a US citizen. However, there’s a chance I won’t have enough time to obtain a US passport before our departure, even by using the Regional Passport Agency.

I will stay for 3 business days in Milan on my way back to New York.

Would it be possible for the Milan US Consulate to issue a US passport, upon presentation of proof of identity (NYS driver’s license and/or Italian passport) and proof of US citizenship (certificate of Naturalization)?"

This is what they replied to me:

"Unfortunately your proposal does not seem to be workable. All regular US passports issued at US embassies and consulates are now actually printed in the US, which means that the turnaround time is approx. 2 weeks since the date of application.

Sincerely,

American Citizens Services Unit"

As you can see the issue is a time issue and not a legal issue. By regular they mean regular applications (or renewals). Of course if somebody's passport is lost or stolen abroad and the US citizen has to go back home, they won't make him/her wait 2 weeks but they'll issue some kind of emergency passport.

Moreover, a friend of mine who lives in London got naturalized when already living in London and she flew back to London right after her oath using her brazilian passport.

She applied for her US passport at the US Embassy in London and she obtained one with no problem in about 20 days.

Times have sure changed, use to travel a lot for my company, always last minute changes, could even pay for a plane ticket with cash, or change my itinerary at the airport. No long lines, no inspections, and planes were normally always on time. Buy a ticket today at the last minute, they cream you with the price. Never a mutually agreement with your appointments at the USCIS, and if you don't show up, can wait for months or years for another. Our shuttle service to O'Hare is crazy, planes are always breaking down at the last minute, so even if you have a three hour layover, miss your flight and have a 15 layover.

If we had to make an emergency flight, could have done it and have gotten the passport the same day, but would have cost of thousands of dollars extra, you can do it too, if you are willing to pay for it.

9/11 really hurt me, my companies insurance company demanded they put a 5 million dollar policy on me for travel, that kind of killed my traveling and my position in the company. And with the poor economy, airplane maintenance went to hell. Do you really need to travel right now?

Can only go by experience, never asked my wife for her green card when leaving, but sure wanted to see it when coming back. You can leave with your Chinese passport, but would be good to use your new US passport when coming back. You don't have to use your US passport when leaving, least in our experiences.

http://travel.state.gov/passport/passport_4312.html shows the location of the 12 offices where you can get a passport the same day, click on the nearest one and get the phone number to make an appointment. We considered this as you can walk in and out with your USC certificate, don't have to worry about them losing it. But if you feel you have strong connections with your US embassy in China, should be a save route as well. Always nice to have connections like that, but we don't.

Your Green Card became invalid when you became a citizen. It's an expired document.

I understand you are (or were) a Chinese citizen.

China does NOT allow dual citizenship so you will enter China with an invalid document.

Now, if I think about countries were I wouldn't like to be in trouble with the law, China definitely comes up on top.

Get a US passport and then a Chinese visa. You have no choice.
