I just spoke with the NVC, and they said that both the K3 and CR1 were expedited by the Embassy, and that even though I started the K3 process, it was our choice to switch to the CR1 process. She said I could do either, and that there is no law that says an Embassy can't issue a K3 visa to an applicant who also has a CR1 application on file with the Embassy. What do you guys advise we do? We've paid for everything and have all documentation for both visas. How does our being on AR status with the K3 impact our CR1? Both of our packets are at the Embassy, we just happened to receive the K3 instructions long before we received the CR1 instructions. Thanks for any advice.

I suggest you go for the CR 1 visa.My husband applied for a K3 visa. CR-1 or what they called conditional spouse is the one where you get the Immigrant visa and K-3 is a non-immigrant visa. If your spouse enter with k-3 visa he would have to apply for adjustment of status and would have to pay $1k+ not sure about the exact amount to make him an immigrant. If your spouse enter with CR-1 visa he will be coming to us as an immigrant already. so do the math? since your papers for k-3 visa and cr-1 visa are already in the embassy why don't you just do the one for the CR-1. you will be able to save some money and papers works. The only difference are the forms that you have to fill up. I'm not an expert on this but this what i understand.

I've read all your treads. I'm sorry to hear what happen to the interview. But sometimes you have to let time take its course.The more you hurry up the more mistakes you'll make the longer it will take thing to happen. So slow down....

Here's my 2 jiao - YMMV -

View the K-3 as the 'initial' visa - if it's denied on interview day, kick the CR-1 into play.

Several folk have used this technique at the Guangzhou Consulate with success.

But -- that was during the last 18 months. Now, a K-3 makes no sense (if one was filing today )

what can ya get for 2 jiao, besides the above advice?

A REALLY REALLY BAD CUP OF COFFEE back in Guanzhou.

correct me if i'm wrong. the k-3 and cr 1 are on the embassy already?right. you have the schedule interview for cr1 and k3? if yes then cr-1 since it will give your spouse a immigrant visa which was really the goal. both visa ends once they approved the interview. maybe the reason why they been asking you to file the 864 is coz they have your cr-1 visa. which requires that form. i don't want to confuse you but better research on the difference of cr-1 and k-3 visa. you would learn more.

gets you to your spouse quicker...price less

In the past it was a lot faster to go the K3 route.. however now you're only saving a few weeks. The price may be less to file the papers.. but not in the long run. It's much more expensive to go the K3 route.

CR-1 is the way to go!

I respectfully disagree.

But everyone have their own opinions. Lets just hope everyone, no matter which route taken, gets interview dates and approvals fast. This who process is very depressing

Thanks for the information and support. We decided to go forward with the CR1, as the NVC advised that the Embassy had approved expedites on both cases. Hope they keep their word!

Well our K3 is on AR due to providing I-134s versus I-864s - but that's what they asked for. Sigh ...

We already paid for both. I just want him here, one way or another. He is my husband, afterall. I do miss him. I'm almost afraid to say that, for fear of sounding "desperate" (the death word at an interview, even if it never escapes your mouth). Thanks for your post.

IMO, they SO WANT TO DENY HIS VISA, so yer jumping through their hoops..
