i left usa due to my husband. he tease me alot , so i came to my country.i dont want to go in detail.i just want to say that i am taking depression tablets now.

i am in india now. i have 10 years green card. my husband still abusing me on emails. he live in ny, i am here in my country from last 5 months , i know after some time my green card will expire.i want to go back to usa but i dont want

to go ny. i want to go some other state, but the problem is that all of my documents has have my husband ny home address , so can somebody tell , will this make a problem for me if i arrive in some other state, and what are the steps i have to take further i want to file for divorce.

Not a good situation but the good news is; You are not tied to NY or any particular state. It is your Permanent Resident card - you are free to change your address any time you like.

For divorce - you would be better off to find a qualified divorce attorney - that would be the first step - you do not have to be in NY to file for divorce.

I suggest you come back, soonish, or you will run some risk of losing your residency status.

as to coming back to HIM - na - not required.

You have a 10 year card - you can pretty much do what ever you want, but come back to USA soonish, yes?

Even if you divorce him, you will not lose the 10 year card.

YOU COULD lose the 10 year card, though, if you are outside the USA for much longer.

You can come back to any state that you want, file for divorce in that state - the court will send him the documents (usually ).

RE: SSN card - if you don't have it , you can get replacement card at a SSA office when you get back in USA. Since you have a 10 year card, you can ask for any 'conditional statements' on the SSC to be removed.

You can do online change of address with the Post office

The post office will forward your mail to the new address for a year.

Same with any bank cards - if you have an online user id for your bank you can change the address online.

"soonish" means in the next 4 weeks, but if you can't arrange to return that quickly you should discuss with US embassy or consulate in india how to file documentation that will keep your green card viable until you are able to return to USA. you need to get on this pronto. do not delay.

get off the medication ASAP. if your problem was the husband and you have been seperate for 5 months then you don't need the pills anymore. psychoactive medications act differently in different people. most of the anti-depressants actually slow most people down and prevent them from acting in their own interest by causing them to care less about the issues they face.

I'm from NY and was divorced.

I think if you have legitimate claim to shared assets you may want to file for divorce in NY.

If you have no such claim it would be much cheaper (and easier) to divorce anywhere but NY.

NY divorce law makes it much more difficult because "fault" has to be proven. When I selected

one of the alternatives to the laundry list of "faults" her lawyer found a loophole in it to stall

the divorce which did neither party any service. Be prepared to pay a lot more for a NY divorce

(also in terms of stress) than one in any other state. If both parties agree you can have a good

uncontested divorce in NY; if they do not, good luck.

You can and should think about going to another state to begin your new life. I don't see any

overwhelming advantages to being in NY if you have no family there.
