I am sorry in advance if this topic is covered somewhere else, and I just missed it. I have read the instruction form on the USCIS web site for filling out form I-134, and looked all over VJ, and I still need some clarification. I am sponsoring my fiance, and my mom will be a co-sponsor. What exactly do I need for evidence?? I have heard I need my tax forms from the last couple of years, but did not read this on the instructions that came with the form on the USCIS web site. Also, since my mother makes way over the poverty line, I have heard she doesn't need the letter from her employer, just her

w-2's and her taxes from the last couple of years. Also, if she makes enough money, does she have to go into what she has in stocks, and savings and other assets?? She will list her home, but not sure she HAS to put down all her assests, or if her income alone is enough. I thank you so much in advance for the information to help me.

There are no specific instructions for the I-134 with the form or on the USCIS website because the form is not generally used by USCIS anymore. USCIS now uses the I-864 affidavit. The I-134 is still used by consulates to pre-screen non-immigrant visa applicants (like K visas) for the "public charge" requirements. Since each consulate can require whatever they want, you will usually get specific instructions from the consulate about what kind of evidence you need to supply.

Most consulates require, as a minimum, a copy of the most recent year's tax return and supporting documents like W2's and 1099's - in other words, the complete tax return, just as it was submitted to the IRS. Most consulates will accept an IRS tax transcript instead of the actual tax return, and some consulates specifically ask for the transcript instead of the tax return. The letter of employment is not usually a strict requirement, and some employers refuse to provide them. Assets, like bank accounts, real estate, and securities, usually do not have to be listed if the sponsor qualifies on income alone.

The above are general statements. The beneficiary will usually receive specific instructions from the consulate regarding the I-134 and what evidence they should provide.

OP specifically said he read the I-134 instructions, but they did not answer his questions.

The "official" I-134 instructions are notoriously vague, and often directly conflict with the instructions given by most consulates. For example, the I-134 instructions say that a copy of the most recent tax return is only required if you are self employed, but most consulates require the tax return as an absolute minimum, and some consulates ask for 3 previous years of returns. The I-134 instructions also say to submit evidence "as appropriate", but makes no attempt to explain when a particular piece of evidence is "appropriate". Someone with a regular salaried job, and who owned no bonds, could follow the I-134 instructions precisely by submitting only a letter from their bank and a letter from their employer. Many if not most consulates wouldn't consider this to be sufficient.

If income is clearly sufficient, she may simply leave blank all spaces asking about assets. A complete tax return and a couple recent pay stubs to verify she's still employed should be sufficient.

Ok so i'm a doofus...lol... I read maybe I missed the instructions to the I-134 I looked all over USCIS website and VJ....doh!!!
