Was talking with my fiance... who lives in U.K....he also visits this site frequently...just doesn't post...that's up to me hehe..... anyhow.....He said he thought he had read somewhere that on the 17th of July, the UCIS will be changing the limits from 125% to 100% above poverty level for income requirements...... Has anyone else heard this or know anything about it???? I told him I would ask...any responses will be welcome! :thumbs:

When it comes to the I-134, there are no clearly defined limits, unlike the I-864 which requires 125% above the poverty limit, or 100% if you are on active duty in the military. It is suggested that you be able to meet the 125% for your K-1 visa, since that is what will be required for AOS.

As for changes in limits, I have not heard anything about that. There are some changes concerning the the new I-864 form and evidence required, but that's all I know about.

The required amount in relation to the poverty level can vary from embassy to embassy. They all seem to be unique. As far as the AOS, it needs to be 125% and I have heard of no change.

I recommend you visit the UK sub forum and find out embassy specific info for your I-134 and income requirements.

As said before you can go to the UK specific forum. But as far as I know there is no change to the 125% above poverty level.

At the interview you will have to provide documentation to satisify the interviewer that you will not become a public charge. When you apply for adjustment of status (after you are married) is when the 125% becomes critical. Although if you cant meet those requirements at the interview, expect either denial or possible delays.

There is no change for the I-134, it has always been 100%:

No. The 125 percent minimum income requirement, the need for the most recent year's tax return and other requirements only apply when an I-864 is needed. Applicants using the I-134 will need to show that their sponsor's income is 100 percent of federal poverty guidelines as required under Section 212(a)(4) of the INA.

but if your that close, they may scrutinize your ability to meet the eventually binding threadhold for the I-864 of 125%.

There are some changes to the Afidavit of Support. You can read about it on the home page of the USCIS website. My take is they seem to be less restrictive rather than more.

The only changes are for the I-864 and variations...

Since the OP is a K1, I assume the question is in regards to the I-134 Aff. of Support... The Federal Register states no change for the I-134:

"Seven commenters asked for clarification of the situations when Form I-134 may be used. The discretion concerning use of Form I-134 has long been quite broad. The sole purpose of 8 CFR 213a.5 is to retain that broad discretion. For this reason, the final rule makes no change to 8 CFR 213a.5."

I-134 filed for the interview has always been 100% of the federal pov guideline. The collective wisdom of this forum is to try to show 125% as that's what you will need later and there will be no fudging at that point.

I-864 filed later on for adjustment of status is 125%. Set in stone no shortages allowed. If there are shortages you may show assets three times the shortfall OR have a joint sponsor.

The pov guidelines themselves do change each spring - usually March or so.

It has been made simpler, but it didnt change the bottom line requirement for 125% above poverty level.

The I-134 doesnt have this requirement and you only have to prove that the person you are sponsoring will not become a public ward. But if you are below the 125% level at the interview time, how do you expect to make the 125% when you adjust status? Others have been in same boat and have been questioned at interview because of being so close to the bottom end of the income level.

Strongly recommend that you get a co sponsor to solve the whole issue.

Ok..here's the link...there are changes concerning the Afadavit of Support..but seems like its getting simpler...to my understanding anyways....

The changes DO NOT apply to the I-134, as has been stated by others already. They are changes for the I-864 (for family based immigrant and AOS). They will come into affect for you with a K visa ONLY after entry to the US for adjustment of status when the I-864 will be required. For the K visa interview you will be using the I-134 if requested.
