Hi there all,

My wife and i were married successfully on July 26th 2009. Her I-94 expires on August 20th and her visa is stamped good until October 27th. We did not get her a SSN when she arrived because we did not know about it. Where do we need to go next? is it the USCIS office in Los Angeles? We have worked so hard to make this work and don't want to see it crumble right here at the last second. What will allow her to stay here while the paper work is processed? if anyone has information it would be greatly appreciated :) thank you all from both my wife and i!

More information - what visa did you enter in on?

You will need to AOS asap. :guides:

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I will assume K-1 entry

visa expiry is meaningless... it is the I-94 that is important...

Next step is to file the I-485...

yes, it is a k-1... So the I-485 is the next step? Do we aquire that at the USCIS office here in Los Angeles? and will that keep her here safe in my arms while it processes? :) and is the Adjustment of Status the same thing as I-485? Thank you very much for your help guys.

adjustment of status = I-485

your local office will not be the place

the I-485 goes to a Chicago address and then on to the National Benefits Center

Read the instructions for the I-485...

Presuming it is a K-1...

1. The "visa stamp" was the date by which she must enter the USA. The visa was cancelled when she did. This was replaced by the I-94. You can still get her an SSN NOW, but better be quick about it. They will not issue an SSN within 14 days of the I-94 expiration and you will have to wait for the green card. So, put aside your other plans and go Monday morning to the SS office. Use her foreign passport and K-1 as the two forms of ID. Though cancelled as a valid visa to enter the USA, it is STILL a valid, government issued ID. Apply for the SSN exactly in the name as appears on her passport and K-1 visa. DO NOT attempt to change her name with SS administration now, wait until she gets her green card. The name she receives the number in is not important, it does not change and she can change her name later. Keep your life simple...use the maiden name for now.

2. Read the guides for Adjustment of status. Write a check for $1010 to the US Department of Homeland Security and read the guides on how to prepare the forms. It is BEST (but not crucial) to send this in before her I-94 expires and keep her from being "out of status"

Yes it will keep her safe in your arms. The I-485 is PART of the AOS package, it is the application but must be supported by LOTS of other stuff (which you already have) Warm up the copy machine. Read the guides for AOS.

We are already married... and the certificate was turned in. it is still legal to get a SSN in her maiden name? and it is really $1010 to send in the package??? they really try and rape every one that trys to immigrate legally huh? hahaha

Unfortunately, yes the AOS does cost $1010. :(

Yes, it is legal to get the SSN in her maiden name. All of her identification is still in that name and she is still listed with immigration in that name. The name on the SSN card needs to agree with the name on her immigration file and while technically you should be able to use the marriage certificate to prove the legal name change, SSA is notoriously bad at knowing the procedure and generally deny the SSN with the married name until you run out of time to get the SSN because the I-94 has expired. It is easier to change the name on her SSN after immigration has changed her name through the AOS. She can use the green card and the marriage certificate for that.
