No Birth Certificate for AOS

Timeline

We are applying for AOS tomorrow and we have all the paperwork ready and I have no birth certificate from my country. What should I do?

I never had a birth certificate so what's the alternative?

Can I go ahead and file the package without a birth certificate? or get affidivit or something else?

Please advise. I am ready to file my petition tomorrow. Can I file it now and later on send the attendum?

08/29/2009 --- Package delivered at Chicago 2.16 PM.

08/31/2009 --- Checks are cashed today.

08/31/2009 --- Received NOA for I-130,I-131, I-485&I-765 (Notice date : 08/29/09)

09/03/2009 --- Received Biometrics letter appt dt. 09/25/2009.

09/04/2009 --- Walk-in biometrics done today. Everything went off well in 30 mins.

09/15/2009 --- Received RFE for NABC

09/18/2009 --- Responded to RFE

09/25/2009 --- Case resumed.

10/04/2009 --- EAD Card Production Ordered

If you go ahead and submit the AOS package - you will very likely (at a minimum) get an RFE for the lack of birth certificate (there's a chance an initial inspection of the package will turn up it is missing and the package could get returned to you - but that may not be very likely).

Is it possible for you to obtain a BC at all? (The time between when you submit the AOS package and when you get an RFE would give you time to get the BC.)

What is your country of origin?

go ahead and file them, get your EAD card and AP, then think about how and where to get the BC later.

Hi. I don't have my birth certificate from my native country either. We just don't have a thing called "birth certificate". Instead, we have something like a family record which states marriage, divorce, death, birth, and such that happens within each family. This is kept at a city hall of my country. I contacted them and got a copy of my family record, and brought it to the nearest consulate. They made me a certified birth certificate in a few days as they are aware that birth certificate is a document required for appying for GC.

So, I suggest that you contact your local consulate or embassy.

B. School record: A letter from the authority (preferably the first school attended) showing the date of admission to the school, the child's date of birth or age at that time, place of birth, and names of the parents.

My Country is India and there is no chance of getting BC back from 30 yrs. But I can get the affidavit from my home town that I was born this place for this parents date and time and get affadavited by Notary. Those days there is no birth certificate given in my place.

You and I share an almost similar culture when it comes to Birth Cirtificates. I don't have a BC since 35 years back our elders weren't in the habbit of obtaining them and even if the hospitals did issue BC's they didn't keep the records for long. I did submit a Government issued Registration Document along with its Translation. I was asked at the interview about my Birth Ciritificate and I explained to the IO that even if I produced one it probably would be a fake. He said, he knows how things are in our region and didn't expect a true BC anyway. So, don't worry. Submit what you have. The IO that will view your case will have enough on your country and its back ground to know we didn't have BC's back then.

Hi,

I have same issue, my father's case is in NVC and i have submitted 2 affidavite on stamp paper from elder's relative of my father regarding BC. Becouse my father was born in 1947 in India so now NVC is asking something in written that India did not have record of birth at that time. I dont know wht to do now....! Now my father is in Pakistan since 1947 and he never obtain BC.

Any idea ????
