Spouse immigrant is Awol from PNP, will he be denied IR-1 Visa???

My husband has been AWOL from PNP (Philippine National Police) for 4 years.. will this be grounds for denial for his petition??

any help pls.. thank you.

USCIS Stage

August 19, 2009: Mailed I-130 to Chicago lockbox priority mail

August 23, 2009: Package received in Chicago

August 27, 2009: NOA1

August 31, 2009: Touched!

September 21, 2009: Touched

September 25, 2009: Touched

Your husband is the permanent resident and is applying for US citizenship, right?

sorry for the lack of info. my husband is still in the Philippines and we are still on the process of applying for the IR-1 visa for him to enter the United States. Im trying to gather as much info if his AWOL status in the PNP will cause him denial of an immigrant visa. thanx.

He has to obtain police clearance. Won't that cause a problem for him with the PNP?

I would think so.... it sounds like a fugitive case... 'case' in which he will of course NOT get a visa.

obtaining a police clearance in the philippines is relatively easy because it is done manually, meaning whatever you did in another city won't usually show in another, unless its an NBI clearance and you are involved in murder or some other torts. however, what i wanted to ask is that by being AWOL (as they will see on his police service record) due to family problems in the past, is that considered as a criminal case to NVC?? technically AWOL is not considered a criminal offense by the PNP, they will just dismiss you from service.

PNP Philippine National Police

sounds like a civilian job? why is AWOL is he under contract or under investigation.

The passage into law on December 13, 1990 of Republic Act No. 6975 entitled �An Act Establishing the Philippine National Police under a reorganized Department of the Interior and Local Government and Other Purposes� ended the existence of the Philippine Constabulary and the Integrated National Police and gave way to the creation of the Philippine National Police, now known as the country's police force that is national in scope and civilian in character. It is administered and controlled by the National Police Commission.

With the affectivity of Republic Act No. 8551, otherwise known as the �Philippine National Police Reform and Reorganization Act of 1998,� the PNP was envisioned to be a community and service oriented Agency. As mandated by law, the PNP activated/created the Internal Affairs Service (IAS) on a national scope on June 1, 1999. It is an organization within the structure of the PNP and one of its tasks is to help the Chief, PNP institute reforms to improve the image of the police force through assessment, analysis and evaluation of the character and behavior of the PNP Personnel. It is headed by the Inspector General.

I don't think it will be areason for him to be denied, it's just like you've been AWOL from a different job. But i think it will be better if he will get a clearance from PNP just to make sure that everything is clear with him and PNP (wherever he was assisgned). I am the wife from the Philippines (FYI).

thank u for the replies. well try to get his case settled with PNP so by the time his police record will be questioned by NVC or at the Embassy, everything will be clear.

Please keep in mind you will need the NBI Cert. not a police record, and this can take 5 to 10 days. Good Luck!
