You are the spouse or unmarried son or daughter of any age of a lawful permanent resident and you have a family-based visa petition approved in your behalf."

NOTE the word if you have have a family-based visa petition approved . You petition family based as a spouse of an LPR ( I-130 ) is not approved. You are illegally present in the US. I have done all I can I wish you the best, but be careful......

are you paying an actual, bar-admitted attorney to file your case? Or is he a notario or immigration consultant? This is very serious. There is NO way your spouse is eligible to adjust status right now, and ANY attorney should know that, let alone one who specializes in immigration.

Unfortunatley, the text you quoted is incomplete. The petition must be approved AND a visa number must be available. Only Immediate Relatives of citizens have a visa number immediately available. You are not a citizen; you can see the Visa Bulletin on travel.state.gov for information on the current priority date.

You need to change lawyers. You can not adjust status from within the United states by being married to a GC holder. When does the spouse become a citizen?

Then by staying in the United states you are risking Deportation as you have no legal standing being here right now. You Visa is expired and you are not eiligible to adjust status at this time. Be very careful because deportation is way worse than a waiver for an over stay.........

Yeah there's no way an LPR can petition for a spouse while here!. That "lawyer" totally messed up your life. The spouse has to go back to his/her country and you have to reapply.

People are very naive and there's always others taking advantage!. Makes me mad

Your wife should find another legal status to stay in the US until the visa number becomes available.
