Hello..just wanna ask something here,i hope someone can help me and to my husband!!!

i have a 2 step daughters and i love them so much they are so nice,smart and fun to be with..My husband and their mother was never been married but the child custody is in my husband but the court said the mother has the right to get the kidz during vacation anytime she likes and also she must give a child support to the 2 girls monthly which is she never did...Now my question is,does the kidz also has the right to refuse to their mother not to go with her?the kidz dont like to stay with their mother,they always crying in every vacation because they know that their mother will come and get them with the cops accompanied her..Just last june 12,the kidz end of school days we came home from the mall and their mother and the cops waiting us and the kidz already told to their mom and to the cops that they wont go with her,but the cops said they'll gonna arrest my husband if the kidz wont go with their mother because according to the cops the kidz has no right to refuse because they are under age..What is the best things and legally to do with it?need some advice..thank you..

i'm not buying this.

I kinda looked at this a little weird too. For me if my Child ( I never forced mine period ) did not want to go for fear or what ever they would have to come through me first and I am MOM !!!!!!!!!!!!!!!!

Why is it that the only one who can stop the crying is the one who started it in the first place?

Can't they garnish the mother's wages for not paying child support? I think you'd still have to go to court to get the order for wage garnishment but that's the way to go if she is 2 years behind on payments.

Why isn't your husband already looking into this?

they can also put the mother in jail for nonsupport. which would solve that pesky visitation issue. :whistle:

The truth is,its really fine to my husband and he dont mind even she did not paying the monthly child support..He thought that the childs has the right to refuse to go with their mother anytime they like,.

I would definitely go after her for child support. Perhaps if she is threatened financially she will be more willing to drop her visitation rights. Definitely get a lawyer and fight this as you don't want the girls going through this all the time. OR hope they are so aweful to her that she won't want to get them back :)
