Hi,

I am getting nervous regarding the administrative processing for my fiance's visa. We were told during the interview that the visa would be granted, and now it is under administrative processing What are the chances that he could be denied during the review process even though they told us yes in the interview? I have knots in my stomach. My fiance is in Cuba. They said they will contact my fiance as soon as the process has been concluded and a final determination has been made. Anyone else been through this process? I'm planning our wedding right now, because I thought we were in the clear. Eeek!!

Our Timeline

We Met: July 2008, Santiago de Cuba, Cuba

Went back and got engaged: November 2008

I-129F Sent : 12-31-2008

I-129F NOA1 : 1-2-2009

I-129F NOA2 : 1-8-2009

NVC Received : 1-20-2009

Going back to visit: February 2009

Visa Interview: 5-18-2009

Visa Approved: 5-18-2009

Administrative Processing Completed: 6-24-2009

Read posts in this forum - almost all Iranian visa's are placed in AP. Your not alone.

Good rule of thumb - don't plan anything concrete until you have the visa in hand...

(or anything that requires a deposit)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

AP can be very short from about a week to very long, 1-2 years. Cuba is one of those unfriendly US countries as is the middle east and south asia. These countries require long AP's. The bad thing is, the timeframe for AP is uncertain and you should not plan anything until you get the visa. Calling your senators and the embassy won't help speed up the process. The good thing is, the embassy did not send the case back to USCIS, which is a much longer process but only sent to DOS or at the embassy level for AP and they would only issue the AP if they believed your relationship and wanted to issue the visa. So they need to do some background checks now and this has to be done at multiple agencies so it can take time. Sometimes the checks are done quickly. Denial is rare in cases where they already believed your case and did not send it to USCIS. Although after they do the checks they can still send it to USCIS if the information you had given during the interview or the data found during the AP was not enough (extensive travelling also delay's AP as they have to verify all the places you went to). You can certainly hope for this but meanwhile do make wedding arrangements and do not buy the plane tickets until the embassy issues the visa.

The OP's case sounds like a name check AP - not a relationship investigation. At the interview the consulate was ready to grant the visa.

OP - check in with the DOS line every other week. As Tammy said, could be a short or long AP -- no way to predict. Don't assume you can go with your planned wedding date. Might plan to get married in the courthouse and plan the family wedding for much further out.

My husband is from the Dominican Republic and was stuck in name check for 11 months -- common latino name with a big drug case in NY. It sucks and you will find support here.

Hey all,

I got an update. I called the visa office this morning and the AP is completed. I am so happy I could jump out of my skin right now. YAY!!!!!!

I got an update. I called the visa office this morning and the AP is completed. I am so happy I could jump out of my skin right now. YAY!!!!!!

oh my god!! great! when I read your post I couldn't believe there would be yet another hoop to jump thru, it made me even more worried about how I am thinking we are only 2 months from being together and we don't have our interview date yet!!! well congratulations, I am so happy for you... :dance: Juana

I am new to this forum but would like to share my experience which is somewhat similar I need HELP !!!! MY interview with my fiance was on July 27, 2011

Make a long story short we were approved we have been together since 2002 we have 9 years together and I have since finished college and am a school teacher.

My father and his father grew up together and I stay for months at a time at our home in the Dominican Republic we are truly in love !! The consular told me you are approved BUT the petition will expire soon. I began to cry and my fiance was calming me down while all the people were staring at me at the window. She told us that we would have to file once again for the petition, I said WHAT??? isnt there anything you can do. She turned the mic off and asked two supervisors and they spoke. She told me ok I can give it to you but you have to wait under ADMINISTRATIVE PROCESSING, she kept his passport and gave us the ticket to pay DOMEX but its been 2 weeks and nothing has happend the petition expired August 6. how is it my fault ??? the interview they gave it to us late.... I dont understand, I call and called the 7 dollars for the pin and they told me to call back in OCTOBER!!!!!???!!! I started to cry what is going on??? I just found out i am PREGNANT and I want to be with him as soon as possible at least before the summer ends. I did everything I paid so much money to get my papers filled out everything right and I still have to go through this??? Please help has anyone else been through this.... She was gonna fill out a green slip and give it to me but she said OH you dont even need this go pay! We are going to do Administrative processing.... please help!
